9   AN ACT T0 CREATE THE TECHNOLOGY AND ENERGY FOR

10  SUSTAINABLE LOGISTICS ACT (TESLA); TO ADD ELECTRIC

11  VEHICLE CHARGING STATIONS TO THE DEFINITION OF

12  "CRITICAL INFRASTRUCTURE" WITH RESPECT TO CRIMINAL

13  OFFENSES RELATED TO DAMAGE OR DESTRUCTION OF

14  PROPERTY; AND FOR OTHER PURPOSES.

18                        TO CREATE THE TECHNOLOGY AND ENERGY FOR

19                        SUSTAINABLE LOGISTICS ACT (TESLA); AND

20                        TO ADD ELECTRIC VEHICLE CHARGING

21                        STATIONS TO THE DEFINITION OF "CRITICAL

22                        INFRASTRUCTURE".

24 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

25

26  SECTION 1. DO NOT CODIFY. This act shall be known and may be cited as

27 the "Technology and Energy for Sustainable Logistics Act (TESLA)".

28

29  SECTION 2. Arkansas Code � 5-38-101(2), concerning the definition of

30 critical infrastructure with respect to damage or destruction of property, is

31 amended to read as follows:

32  (2) "Critical infrastructure" means any of the following

33 facilities that are either completely enclosed by a fence or other physical

34 barrier that is designed to exclude persons without permission to be in the

35 facility or otherwise is clearly marked with signs that are reasonably likely

36 to be seen by another person that indicate entry or unauthorized access or

1 use is limited or restricted or otherwise forbidden without facility

2 authorization:

3                   (A) A chemical or rubber manufacturing facility;

4                   (B) A water intake structure, water treatment facility,

5 wastewater facility, drainage facility, water management facility, or any

6 similar water or sewage treatment system and the water or sewage treatment

7 system's piping;

8                   (C) A food processing or manufacturing facility;

9                   (D) A natural gas company facility, an underground gas

10 storage facility, or interstate natural gas pipeline, including without

11 limitation:

12                         (i) A pipeline interconnection;

13                         (ii) A natural gas compressor station and associated

14 facility;

15                         (iii) A city gate or town border station;

16                         (iv) A metering station;

17                         (v) Aboveground piping;

18                         (vi) A regulator station;

19                         (vii) A valve site;

20                         (viii) A delivery station; and

21                         (ix) Fabricated assembly and any part of a natural

22 gas storage facility involved in the gathering, storage, transmission, or

23 distribution of gas;

24                  (E) Wireline or wireless telecommunications

25 infrastructure, including telecommunications towers, telephone poles,

26 telephone lines, and fiber optic lines;

27                  (F) A port, trucking terminal, or other freight

28 transportation facility;

29                  (G) A gas processing plant, including a gas processing

30 plant used in the processing, treatment, or fractionation of natural gas or

31 natural gas liquids;

32                  (H) A crude oil or refined products storage and

33 distribution facility, including without limitation:

34                         (i) A valve site;

35                         (ii) A pipeline interconnection;

36                         (iii) A pump station;

1                          (iv) A metering station;

2                          (v) A belowground or aboveground pipeline or piping;

3                          (vi) A truck loading or off-loading facility; and

4                          (vii) An aboveground portion of a well, well pad, or

5 production operation;

6                 (I) A laydown area or construction site for pipe and other

7 equipment intended for use on an interstate or intrastate natural gas or

8 crude oil pipeline;

9                 (J) A portion of an oil, gas, hazardous liquid, or

10 chemical pipeline, tank, or other storage facility that is aboveground;

11                (K) A video service network and broadband infrastructure,

12 including without limitation:

13                         (i) Associated buildings and facilities;

14                         (ii) Video service headends, towers, utility poles,

15 and utility lines; and

16                         (iii) Fiber optic lines;

17                (L) A mining operation, including any processing

18 equipment, batching operation, or support facility for that mining operation;

19                (M) A facility installed in a public right-of-way on a

20 utility pole or in a conduit that is aboveground and concerns a video service

21 network or broadband or wireless telecommunications infrastructure;

22                (N) Railroad property; and

23                (O) Property owned by and considered an electronic asset

24 of any of the following:

25                         (i) An electric utility;

26                         (ii) An electric cooperative;

27                         (iii) A municipal electric utility;

28                         (iv) A natural gas company that is a public utility;

29                         (v) A telephone company that is a public utility; or

30                         (vi) A video service provider, including a cable

31 operator; and

32                (P) An electric vehicle charging station;
