9   AN ACT TO CLARIFY THAT AN ADVANCED PRACTICE

10  REGISTERED NURSE WHO PRESCRIBES A STIMULANT MAY

11  SUBSTITUTE A THERAPEUTICALLY EQUIVALENT MEDICATION;

12  AND FOR OTHER PURPOSES.

16                       TO CLARIFY THAT AN ADVANCED PRACTICE

17                       REGISTERED NURSE WHO PRESCRIBES A

18                       STIMULANT MAY SUBSTITUTE A

19                       THERAPEUTICALLY EQUIVALENT MEDICATION.

21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22

23  SECTION 1. Arkansas Code � 17-87-310(b)(2)(B)(ii), concerning the

24 prescriptive authority of an advanced practice registered nurse, is amended

25 to read as follows:

26                          (ii)(a) The prescription is for a stimulant.

27                             (b) A prescription for a stimulant shall meet

28 the following criteria:

29                                          (1) The prescription was originally

30 initiated by a physician;

31                                          (2) The physician has evaluated the

32 patient within six (6) months before the advanced practice registered nurse

33 issues a prescription; and

34                                          (3) The prescription by the advanced

35 practice registered nurse is to treat the same condition as the original

36 prescription.

1                          (c) An advanced practice registered nurse may

2 substitute a therapeutically equivalent medication of the drug prescribed by

3 the physician under subdivision (b)(2)(B)(ii) of this section.

4                          (d) If the advanced practice registered nurse

5 substitutes a therapeutically equivalent medication under subdivision

6 (b)(2)(B)(ii)(c) of this section, the advanced practice registered nurse

7 shall notify the physician who originally prescribed the stimulant of the

8 substitution.
