10  CONCERNING THE EFFECTIVE DATE OF ACTS 2025, NO. 408;

11  TO DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES.

17                       ACTS 2025, NO. 408; AND TO DECLARE AN

18                       EMERGENCY.

20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22  SECTION 1. Acts 2025, No. 408, � 23, is amended to read as follows:

23  SECTION 23. EMERGENCY CLAUSE. It is found and determined by the

24 General Assembly, that the Constitution of the State of Arkansas prohibits

25 the appropriation of funds for more than a one (1) year period; that the

26 effectiveness of this Act on July 1, 2026 2025 is essential to the operation

27 of the agency for which the appropriations in this Act are provided; with the

28 exception that Sections 15 and 20 in this Act shall be in full force and

29 effect from and after the date of its passage and approval; and that in the

30 event of an extension of the Session, the delay in the effective date of this

31 Act beyond July 1, 2026 2025, with the exception that Sections 15 and 20 in

32 this Act shall be in full force and effect from and after the date of its

33 passage and approval, could work irreparable harm upon the proper

34 administration and provision of essential governmental programs. Therefore,

35 an emergency is hereby declared to exist and this Act being necessary for the

36 immediate preservation of the public peace, health and safety shall be in

1 full force and effect from and after July 1, 2026 2025; with the exception of

2 Sections 15 and 20 in this Act shall be in full force and effect from and

3 after the date of its passage and approval.

5   SECTION 2. EMERGENCY CLAUSE. It is found and determined by the

6 General Assembly of the State of Arkansas that the office of the Secretary of

7 State provides vital services, including without limitation the regulation of

8 elections and the registration of business entities, that preserve the public

9 peace, health, and safety; that due to an error in Acts 2025, No. 408,

10 funding for the office would lapse when its current appropriation expires at

11 the end of the current fiscal year; and that the immediate effectiveness of

12 this act is necessary to preserve the public peace, health, and safety as it

13 will ensure that funding for the office is in place at the beginning of the

14 next fiscal year and allow proper planning for the fiscal operations of the

15 office. Therefore, an emergency is declared to exist, and this act being

16 immediately necessary for the preservation of the public peace, health, and

17 safety shall become effective on:

18           (1) The date of its approval by the Governor;

19           (2) If the bill is neither approved nor vetoed by the Governor,

20 the expiration of the period of time during which the Governor may veto the

21 bill; or

22           (3) If the bill is vetoed by the Governor and the veto is

23 overridden, the date the last house overrides the veto.
