9               AN ACT TO AMEND THE LAW CONCERNING THE SUSPENSION,

10              REVOCATION, OR NONRENEWAL OF A PERSON'S DRIVER'S

11              LICENSE FOR FAILURE TO PAY A COURT-ORDERED FINE; TO

12              AMEND THE LAW CONCERNING A DEFENDANT'S INABILITY TO

13              IMMEDIATELY PAY A COURT-ORDERED FINE; AND FOR OTHER

14              PURPOSES.

18                       TO AMEND THE LAW CONCERNING THE

19                       SUSPENSION, REVOCATION, OR NONRENEWAL OF

20                       A PERSON'S DRIVER'S LICENSE FOR FAILURE

21                       TO PAY A COURT-ORDERED FINE; AND TO

22                       AMEND THE LAW CONCERNING A DEFENDANT'S

23                       INABILITY TO PAY A COURT-ORDERED FINE.

25 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

26

27  SECTION 1. Arkansas Code � 16-13-702(a)(5)(A), concerning the

28 immediate payment of a court imposed fine by a defendant, is amended to read

29 as follows:

30              (5)(A)(i) If the defendant claims an inability to pay the fine,

31 the court shall inquire into the defendant's ability to pay and shall make a

32 determination of the defendant's financial ability to pay the fine.

33                          (ii) To assist the court in making a determination

34 of the defendant's financial ability to pay a fine under subdivision

35 (a)(5)(A)(i) of this section, the defendant shall provide to the court

36 information regarding the defendant's:

1                                (a) Monthly income;

2                                (b) Monthly housing costs;

3                                (c) Monthly utility costs;

4                                (d) Monthly childcare costs;

5                                (e) Monthly transportation costs;

6                                (f) Monthly healthcare costs;

7                                (g) Monthly tax liability; and

8                                (h) Other necessary monthly costs.

10  SECTION 2. Arkansas Code � 16-13-708(a), concerning the revocation,

11 suspension, or nonrenewal of a driver's license requested by a court from the

12 Department of Finance and Administration, is amended to add an additional

13 subdivision read as follows:

14  (4) When making a determination to request a revocation,

15 suspension, or nonrenewal of a person's driver's license under subdivision

16 (a)(1) of this section, the court shall consider the information provided

17 under � 16-13-702(a)(5)(A)(ii).

19  SECTION 3. Arkansas Code � 16-13-708(b), concerning the revocation,

20 suspension, or nonrenewal of a driver's license requested by a court from the

21 Department of Finance and Administration, is amended to read as follows:

22  (b)(1) For a driver's license revocation, suspension, or nonrenewal,

23 the court must provide the department with the reason for the revocation,

24 suspension, or nonrenewal, the amount the person owes the court, and the

25 person's full name, date of birth, and last known address.

26  (2) If a person fails to provide the court with the information

27 required under � 16-13-702(a)(5)(A)(ii), the court shall include a

28 notification to the department of the person's failure to provide the

29 required information with the court's request for a driver's license

30 revocation, suspension, or nonrenewal.
