15 ASSET LIMIT BASED UPON INFLATION; AND FOR OTHER

24 PROGRAM; AND TO AMEND THE ASSET LIMITS
25 UNDER THE PROGRAM.

27 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

29 SECTION 1. Arkansas Code � 20-76-115 is amended to read as follows:
30 20-76-115. Resource limits for Supplemental Nutrition Assistance
31 Program -- Resource limit Broad-based categorical eligibility waiver.
32 (a) Unless required by federal law, the Department of Human Services
33 shall not:
34 (1) Apply gross income standards for food assistance higher than
35 the standards specified in 7 U.S.C. � 2014(c); or
36 (2) Grant categorical eligibility that exempts households from

1 the gross income standard under subdivision (a)(1) of this section for any
2 noncash, in-kind, or other benefit unless under a broad-based categorical
3 eligibility waiver is obtained under subsection (b) of this section.
4 (b)(1)(A) The Department of Human Services shall request a broad-based
5 categorical eligibility waiver from the United States Department of
6 Agriculture to exempt Supplemental Nutrition Assistance Program applicants
7 and enrollees from the federal resource limit, subject to the asset limits
8 under subdivision (b)(2) of this section.
9 (B) The Department of Human Services may request a broad-
10 based categorical eligibility waiver from the United States Department of
11 Agriculture if a waiver is necessary to implement the asset limits under
12 subdivision (b)(2) of this section.
13 (2)(c)(1) Upon the Department of Human Services obtaining the
14 broad-based categorical eligibility waiver requested under subdivision (b)(1)
15 of this section:,
16 (A) The the asset limit under the Supplemental Nutrition
17 Assistance Program shall be equal to the federal resource limit; six thousand
18 dollars ($6,000).
19 (2) The asset limit under subdivision (c)(1) of this section
20 shall be automatically adjusted for inflation on a biennial basis.
21 (B)(i) If an enrolled household is determined by the
22 Department of Human Services to have accumulated countable assets greater
23 than the federal resource limit, the Department of Human Services shall grant
24 a temporary increase of the asset limit for that household to an amount set
25 by the Department of Human Services by rule for a period of up to one (1)
26 year.
27 (ii) The Department of Human Services shall set the
28 temporary asset limit at five thousand five hundred dollars ($5,500) and may
29 seek waiver approval from the United States Department of Agriculture to
30 modify that amount to correspond with future changes in the federal resource
31 limit; and
32 (C) An enrolled household may receive a temporary increase
33 of the asset limit no more than one (1) time every five (5) years.
