9   AN ACT TO AMEND THE LAW CONCERNING THE ARKANSAS MOTOR

10  CARRIER ACT, 1955; TO REQUIRE AN OPERATOR OF A

11  COMMERCIAL MOTOR VEHICLE TO HAVE ENGLISH LANGUAGE

12  PROFICIENCY; AND FOR OTHER PURPOSES.

16                       TO AMEND THE LAW CONCERNING THE ARKANSAS

17                       MOTOR CARRIER ACT, 1955; AND TO REQUIRE

18                       AN OPERATOR OF A COMMERCIAL MOTOR

19                       VEHICLE TO HAVE ENGLISH LANGUAGE

20                       PROFICIENCY.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24  SECTION 1. Arkansas Code Title 23, Chapter 13, Subchapter 2, is

25 amended to add an additional section to read as follows:

26  23-13-266. Operating a commercial motor vehicle without sufficient

27 English language proficiency.

28  (a) A person commits the offense of operating a commercial motor

29 vehicle without sufficient English language proficiency if the person:

30  (1) Operates a commercial motor vehicle, as defined under 49

31 C.F.R. 390.5T, as it existed on January 1, 2025, in the state; and

32  (2) Cannot read or speak the English language sufficiently to:

33                       (A) Converse with the general public;

34                       (B) Understand highway traffic signs and signals in the

35 English language;

36                       (C) Respond to official inquiries; and

1   (D) Make entries on reports and records.

2   (b) Operating a commercial motor vehicle without sufficient English

3 language proficiency is a violation subject to a fine under � 23-13-257.
