10 TO AMEND THE LAW CONCERNING THE QUALIFICATIONS FOR AN
11 INTERMEDIATE DRIVER'S LICENSE; AND FOR OTHER
12 PURPOSES.

18 CONCERNING THE QUALIFICATIONS FOR AN
19 INTERMEDIATE DRIVER'S LICENSE.

21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

23 SECTION 1. Arkansas Code � 27-16-701(a)(2), concerning the application
24 for a driver's license or instruction permit, is amended to read as follows:
25 (2) The commercial driver's license or noncommercial driver's
26 license shall include the:
27 (A) An intermediate driver's license issued to persons who
28 are less than eighteen (18) years of age; and the
29 (B) A learner's license issued to persons who are less
30 than sixteen (16) years of age.

32 SECTION 2. Arkansas Code � 27-16-704(b)(7), concerning the examination
33 of an application for a driver's license, is amended to read as follows:
34 (7) In addition, the applicant for a learner's license and an
35 intermediate driver's license shall have the student's applicant's driving
36 record checked to verify that the student applicant has been free of a

1 serious accident and conviction of a serious traffic violation for the last
2 six (6) months and that an applicant with an intermediate driver's license
3 applying for a regular license has been free of a serious accident and
4 conviction of a serious traffic violation for the last twelve (12) months.

6 SECTION 3. Arkansas Code � 27-16-801(a)(1)(A)(ii), concerning the
7 requirement that the Office of Driver Services issue certain licenses, is
8 amended to read as follows:
9 (ii) An intermediate Class D license or an
10 intermediate Class M license to each applicant between who is sixteen (16)
11 and eighteen (18) years of age or older, for a period of up to two (2) years,
12 upon payment of twelve dollars ($12.00);

14 SECTION 4. Arkansas Code � 27-16-804(g)(1)(A), concerning the issuance
15 of intermediate driver's licenses, is amended to read as follows:
16 (g)(1)(A) The Office of Driver Services shall have authority to issue
17 to those persons under eighteen (18) who are at least sixteen (16) years of
18 age a restricted driver's license to be known as an "intermediate driver's
19 license".

21 SECTION 5. Arkansas Code � 27-16-901(a)(1)(B)(ii), concerning the
22 expiration and renewal of driver's licenses, is amended to read as follows:
23 (ii) Any person sixteen (16) years of age or older
24 may apply for an intermediate driver's license, provided that his or her
25 driving record is free of a serious accident and conviction of a serious
26 traffic violation for the most recent six-month period.

28 SECTION 6. Arkansas Code � 27-16-901(a)(1)(C), concerning the
29 expiration and renewal of driver's licenses, is amended to read as follows:
30 (C)(i) An intermediate driver's license shall be issued
31 for no more than a two-year period and shall expire immediately upon the:
32 (a) The driver's reaching eighteen (18) years
33 of age, and if:
34 (1) The intermediate driver has been
35 free of a serious accident and conviction of a serious traffic violation for
36 at least twelve (12) months before arriving at his or her eighteenth

1 birthday; and
2 (2) The intermediate driver's license
3 was issued to the intermediate driver before his or her eighteenth birthday;
4 or
5 (b) If the intermediate driver was eighteen
6 (18) years of age or older when his or her intermediate driver's license was
7 issued, the time at which the intermediate driver has been free of a serious
8 accident and conviction of a serious traffic violation for at least twelve
9 (12) months.
10 (ii) An intermediate driver's license may be renewed
11 at that the time of expiration or within thirty (30) days following the
12 expiration date of the intermediate driver's license as a:
13 (a) A regular driver's license for eight (8)
14 years, so long as the intermediate driver has been free of a serious accident
15 and conviction of a serious traffic violation for at least twelve (12) months
16 before arriving at his or her eighteenth birthday if the conditions stated in
17 subdivision (a)(1)(C)(i) of this section are met; or
18 (b) An intermediate driver's license for two
19 (2) years if the conditions stated in subdivision (a)(1)(C)(i) of this
20 section are not met.
