9   AN ACT TO AMEND PROVISIONS OF THE ARKANSAS CODE TO

10  PROVIDE SCHOOL DISTRICTS WITH FLEXIBILITY REGARDING

11  ALTERNATIVE LEARNING ENVIRONMENTS; AND FOR OTHER

12  PURPOSES.

16                        TO AMEND PROVISIONS OF THE ARKANSAS CODE

17                        TO PROVIDE SCHOOL DISTRICTS WITH

18                        FLEXIBILITY REGARDING ALTERNATIVE

19                        LEARNING ENVIRONMENTS.

20

21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22

23  SECTION 1. Arkansas Code � 6-18-503(a)(1)(C), concerning disciplinary

24 policies required for public school districts, is amended to read as follows:

25                        (C) The discipline policy required under subdivision

26 (a)(1)(A) of this section shall include provisions for:

27                        (i) Placement of a student with disciplinary,

28 socially dysfunctional, or behavioral problems not associated with a physical

29 or mental impairment or disability in an alternative learning environment

30 provided by the district, if the district provides an alternative learning

31 environment; and

32                        (ii) Procedures for responding to reports received

33 through the school safety and crisis line under � 6-18-111.

35  SECTION 2. Arkansas Code � 6-48-102 is amended to read as follows:

36  6-48-102. Alternative learning environment required -- Reporting.

1   (a)(1) A school district shall may provide one (1) or more alternative

2 learning environments for all students who meet the minimum criteria

3 established by the Division of Elementary and Secondary Education.

4   (2) A school district complies with this section if the school

5 district provides may provide an alternative learning environment by one (1)

6 or more of the following methods:

7                (A) Establishes and operates Establishing and operating an

8 alternative learning environment;

9                (B) Cooperates Cooperating with one (1) or more other

10 school districts to establish and operate an alternative learning

11 environment;

12               (C) Uses Using an alternative learning environment

13 operated by an education service cooperative established under The Education

14 Service Cooperative Act of 1985, � 6-13-1001 et seq.; or

15               (D) Partners Partnering with a state-supported institution

16 of higher education and technical institutes to provide concurrent courses or

17 technical education options for academic learning to students in grades eight

18 through twelve (8-12).

19  (b) Annually, a school district that provides an alternative learning

20 environment under this section shall submit to the division:

21  (1) Information on race and gender of the students educated in

22 the alternative learning environment;

23  (2) Any other information regarding students educated in

24 alternative learning environments that the division requires by rule; and

25  (3) An assurance statement that the school district is in

26 compliance with this chapter.
