9   AN ACT TO AMEND THE LAW REGARDING EMOTIONAL SUPPORT

10  ANIMALS; TO AUTHORIZE A PRIVATE PROPERTY OWNER OR

11  BUSINESS OWNER TO BAN AN EMOTIONAL SUPPORT ANIMAL

12  FROM THE PRIVATE PROPERTY OR THE BUSINESS PREMISES;

13  TO REGULATE LIABILITY ON PRIVATE PROPERTY RELATED TO

14  EMOTIONAL SUPPORT ANIMALS; AND FOR OTHER PURPOSES.

19                       BUSINESS OWNER TO BAN AN EMOTIONAL

20                       SUPPORT ANIMAL FROM THE PRIVATE PROPERTY

21                       OR THE BUSINESS PREMISES; AND TO

22                       REGULATE LIABILITY ON PRIVATE PROPERTY

23                       RELATED TO EMOTIONAL SUPPORT ANIMALS.

25 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

27  SECTION 1. Arkansas Code Title 20, Chapter 14, Subchapter 10, is

28 amended to add an additional section to read as follows:

29  20-14-1005. Emotional support animals on private property or business

30 premises -- Liability.

31  (a)(1) Unless prohibited by the Fair Housing Act, 42 U.S.C. � 3601 et

32 seq., as it existed on January 1, 2025, or other existing federal law, a

33 private property owner may ban an emotional support animal from his or her

34 private property.

35  (2) If the private property is a business, the business owner

36 may ban an emotional support animal from the business premises by:

1                  (A) Verbally telling a customer or visitor that the

2 emotional support animal is not allowed on the business premises; or

3                  (B) Posting a sign in a conspicuous place at the entrance

4 of the business premises stating that emotional support animals are

5 prohibited.

6   (b) A private property owner or business owner shall not be held

7 liable for an injury to a customer or visitor by an emotional support animal

8 except in a case of gross negligence by the private property owner or

9 business owner.
