11 LED ORGANIZED CARE ACT; TO ALLOW THE GOVERNOR TO
12 DESIGNATE MEDICAID BENEFICIARY POPULATIONS TO BE
13 ENROLLED UNDER THE MEDICAID PROVIDER-LED ORGANIZED
14 CARE ACT UPON APPROVAL OF THE LEGISLATIVE COUNCIL;
15 AND FOR OTHER PURPOSES.

20 MEDICAID BENEFICIARY POPULATION AND
21 ALLOW THE GOVERNOR TO DESIGNATE MEDICAID
22 POPULATIONS TO BE ENROLLED UNDER THE
23 MEDICAID PROVIDER-LED ORGANIZED CARE

26 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

28 SECTION 1. Arkansas Code � 20-77-2703(7), concerning the definition of
29 "enrollable Medicaid beneficiary population" within the Medicaid Provider-Led
30 Organized Care Act, is amended to read as follows:
31 (7) "Enrollable Medicaid beneficiary population" means a group
32 of individuals who are either:
33 (A) Members of a covered Medicaid beneficiary population;
34 or
35 (B) Members of a voluntary Medicaid beneficiary
36 population; or

1 (C) Members of a Medicaid beneficiary population
2 designated by the Governor and approved by the Legislative Council;

4 SECTION 2. Arkansas Code � 20-77-2705, concerning excluded services
5 under the Medicaid Provider-Led Organized Care Act, is amended to add an
6 additional subsection to read as follows:
7 (c) The Medicaid provider-led organized care system shall exempt
8 services provided under the 340B Drug Pricing Program if populations enrolled
9 in qualified health insurance plans under the Arkansas Health and Opportunity
10 for Me Program are designated by the Governor and approved by the Legislative
11 Council as an enrollable Medicaid beneficiary population.
