10 AN ACT TO AMEND THE ARKANSAS HUMAN LIFE PROTECTION
11 ACT AND THE ARKANSAS UNBORN CHILD PROTECTION ACT TO
12 ADD EXCEPTIONS FOR A PREGNANCY THAT IS THE RESULT OF
13 INCEST OR RAPE, IN THE CASE OF A FETAL ABNORMALITY
14 INCOMPATIBLE WITH LIFE, AND TO SAVE THE HEALTH OF THE
15 MOTHER IN THE CASE OF A MEDICAL EMERGENCY; TO MODIFY
16 THE DEFINITION OF "MEDICAL EMERGENCY" WITHIN THE
17 ARKANSAS HUMAN LIFE PROTECTION ACT AND THE ARKANSAS
18 UNBORN CHILD PROTECTION ACT; AND FOR OTHER PURPOSES.

27 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

29 SECTION 1. Arkansas Code � 5-61-303(3), concerning the definition of
30 "medical emergency" within the Arkansas Human Life Protection Act, is amended
31 to read as follows:
32 (3) "Medical emergency" means a condition in which an abortion
33 is necessary to preserve the life or health of a pregnant woman whose life or
34 health is endangered by a physical disorder, physical illness, or physical
35 injury, including a life-endangering or health-endangering physical condition
36 caused by or arising from the pregnancy itself; and

2 SECTION 2. Arkansas Code � 5-61-304(a), concerning the prohibitions
3 under the Arkansas Human Life Protection Act, is amended to read as follows:
4 (a) A person shall not purposely perform or attempt to perform an
5 abortion except:
6 (1) To to save the life or health of a pregnant woman in a
7 medical emergency;
8 (2) When the pregnancy is the result of incest for which a
9 report has been filed with a law enforcement agency or prosecuting attorney's
10 office alleging the offense of incest, � 5-26-202, or the sexual assault of a
11 minor;
12 (3) When the pregnancy is the result of a rape for which a
13 report has been filed with a law enforcement agency or prosecuting attorney's
14 office alleging the offense of rape, � 5-14-103; or
15 (4) In the case of a fetal abnormality incompatible with life.

17 SECTION 3. Arkansas Code � 5-61-403(3), concerning the definition of
18 "medical emergency" within the Arkansas Unborn Child Protection Act, is
19 amended to read as follows:
20 (3) "Medical emergency" means a condition in which an abortion
21 is necessary to preserve the life or health of a pregnant woman whose life or
22 health is endangered by a physical disorder, physical illness, or physical
23 injury, including a life-endangering or health-endangering physical condition
24 caused by or arising from the pregnancy itself; and

27 under the Arkansas Unborn Child Protection Act, is amended to read as
28 follows:

32 medical emergency;
33 (2) When the pregnancy is the result of incest for which a
