9   AN ACT CONCERNING VOTER REGISTRATION LISTS; TO ALLOW

10  THE SECRETARY OF STATE TO PROVIDE A VOTER

11  REGISTRATION LIST TO FEDERAL COURTS; AND FOR OTHER

12  PURPOSES.

19                       FEDERAL COURTS.

21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22

23  SECTION 1. Arkansas Code Title 7, Chapter 1, Subchapter 1, is amended

24 to add an additional section to read as follows:

25  7-1-116. Voter registration lists provided to federal courts.

26  (a) The Secretary of State may provide a voter registration list to a

27 federal court for purposes of selecting jurors on the condition that the

28 federal court jury coordinator provides notice to the Secretary of State

29 regarding an ineligible or potentially ineligible voter under subsection (b)

30 of this section.

31  (b)(1) The notice under subsection (a) of this section shall include

32 a list of each person disqualified or potentially disqualified as a

33 prospective juror from jury service due to the prospective juror being:

34                       (A) A noncitizen of the United States;

35                       (B) Convicted of a felony;

36                       (C) Deceased;

1             (D) A nonresident of this state; or

2             (E) A nonresident of the county.

3             (2) The notice under subsection (a) of this section shall

4 include the following information for each disqualified juror:

5             (A) The full name of the disqualified juror;

6             (B) Current and prior addresses, if any;

7             (C) Telephone number, if available;

8             (D) Date of birth; and

9             (E) The reason the prospective juror was disqualified.

10            (3) The federal court jury coordinator may provide additional

11 documentation showing the person's disqualification under subsection (b) of

12 this section with the notice submitted to the Secretary of State.

13  (c)(1) The notice prepared under subsection (a) of this section shall

14 be sent to the Secretary of State according to the jury summons cycle used by

15 the federal district court clerk.

16            (2) Subdivision (c)(1) of this section does not prevent the

17 notice from being sent more frequently.

18            (3) The notice under subsection (a) of this section may be

19 provided to the Secretary of State by:

20            (A) Mail;

21            (B) Facsimile transmission; or

22            (C) Email.

23  (d)(1) After verifying that the person disqualified or potentially

24 disqualified as a prospective juror is a registered voter but is ineligible

25 to be a voter under Arkansas law, the Secretary of State shall forward the

26 information to the county clerk where the voter is registered.

27            (2) The county clerk shall follow the procedures to remove the

28 voter from the voter registration list under Arkansas Constitution, Amendment

29 51, � 11.
