9   AN ACT TO MODIFY THE PERIOD THAT A VISITING

10  QUALIFYING PATIENT REGISTRY IDENTIFICATION CARD IS

11  VALID; TO ESTABLISH A PROCESS FOR RENEWAL OF A

12  QUALIFYING PATIENT REGISTRY IDENTIFICATION CARD FOR

13  MEDICAL MARIJUANA; AND FOR OTHER PURPOSES.

21                       QUALIFYING PATIENT REGISTRY

22                       IDENTIFICATION CARD.

24 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

25

26  SECTION 1. Arkansas Code � 20-56-307 is amended to read as follows:

27  20-56-307. Visiting qualifying patient registry identification card.

28  A registry identification card for a visiting qualifying patient shall

29 be extended for a period of ninety (90) days valid for one (1) year from the

30 date of issuance.

32  SECTION 2. Arkansas Code Title 20, Chapter 56, Subchapter 3, is

33 amended to add additional sections to read as follows:

34  20-56-309. Qualifying patient registry identification card renewal.

35  (a) A qualifying patient registry identification card expires one (1)

36 year after issuance unless the certifying physician designates an earlier

1 expiration.

2         (b)(1) A qualifying patient may obtain a renewal of a qualifying

3 patient registry identification card by submitting a written request to the

4 Department of Health.

5              (2) The department shall not require an additional certification

6 from a certifying physician for a renewal of a qualifying patient registry

7 identification card.

8         (c)(1) After a qualifying patient registry identification card has

9 been renewed once, a new certification from a certifying physician shall be

10 submitted to obtain a new qualifying patient registry identification card.

11             (2) A new qualifying patient registry identification card under

12 subdivision (c)(1) of this section may be renewed as provided under

13 subdivision (b) of this section.

14        (d) The Department of Health may promulgate rules to implement this

15 section.

17        20-56-310. Universal registry identification card.

18        (a) An individual who is employed or provides services to a dispensary

19 or cultivation facility shall be issued a universal registry identification

20 card.

21        (b)(1) An individual holding a universal registry identification card

22 shall notify the Alcoholic Beverage Control Division in writing before

23 initiating employment or services to a dispensary or cultivation facility.

24             (2) The division shall maintain a record of each dispensary or

25 cultivation facility that is a designated facility of an individual holding a

26 universal registry identification card.

27        (c) The division may promulgate rules to implement this section.
