8                          For An Act To Be Entitled

9   AN ACT TO AMEND THE LAW CONCERNING THE OFFENSE OF

10  FLEEING BY MEANS OF A VEHICLE OR CONVEYANCE; TO

11  INCREASE THE PENALTY FOR A PERSON WHO JUMPS FROM A

12  MOVING VEHICLE OR CONVEYANCE WHILE FLEEING; AND FOR

13  OTHER PURPOSES.

17                       TO AMEND THE LAW CONCERNING THE OFFENSE

18                       OF FLEEING BY MEANS OF A VEHICLE OR

19                       CONVEYANCE; AND TO INCREASE THE PENALTY

20                       FOR A PERSON WHO JUMPS FROM A MOVING

21                       VEHICLE OR CONVEYANCE WHILE FLEEING.

23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

25  SECTION 1. Arkansas Code � 5-54-125(d), concerning the criminal

26 penalties for fleeing by means of any vehicle or conveyance, is amended to

27 add an additional subdivision to read as follows:

28  (5)(A) Fleeing by means of any vehicle or conveyance under

29 subdivisions (d)(2) of this section is a Class C felony if the person exited

30 the vehicle while the vehicle or conveyance was still moving and continued to

31 flee on foot during the course of the offense.

32                        (B) Fleeing by means of any vehicle or conveyance under

33 subdivisions (d)(3) of this section is a Class B felony if the person exited

34 the vehicle while the vehicle or conveyance was still moving and continued to

35 flee on foot during the course of the offense.

36                        (C) Fleeing by means of any vehicle or conveyance under

1 subdivisions (d)(4) of this section is a Class A felony if the person exited

2 the vehicle while the while the vehicle or conveyance was still moving and

3 continued to flee on foot during the course of the offense.
