9   AN ACT TO AMEND THE MEDICAID PROVIDER-LED ORGANIZED

10  CARE ACT TO ENSURE THAT SEDATION DENTISTRY IS COVERED

11  BY RISK-BASED PROVIDER ORGANIZATIONS; AND FOR OTHER

12  PURPOSES.

16                       TO AMEND THE MEDICAID PROVIDER-LED

17                       ORGANIZED CARE ACT TO ENSURE THAT

18                       SEDATION DENTISTRY IS COVERED BY RISK-

19                       BASED PROVIDER ORGANIZATIONS.

21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22

23  SECTION 1. Arkansas Code � 20-77-2703(6), concerning the definition of

24 "direct service provider" within the Medicaid Provider-Led Organized Care

25 Act, is amended to read as follows:

26  (6) "Direct service provider" means an organization or

27 individual that delivers healthcare services, including sedation dentistry,

28 to enrollable Medicaid beneficiary populations;

29

30  SECTION 2. Arkansas Code � 20-77-2703, concerning definitions within

31 the Medicaid Provider-Led Organized Care Act, is amended to add an additional

32 subdivision to read as follows:

33  (15) "Sedation dentistry" means the administration of sedative

34 medications during dental procedures to address routine and complex dental

35 care needs, including minimal sedation, moderate sedation, deep sedation, and

36 general anesthesia.

2   SECTION 3. Arkansas Code � 20-77-2705(b), concerning the excluded

3 services under the Medicaid Provider-Led Organized Care Act, is amended to

4 read as follows:

5   (b) The Medicaid provider-led organized care system shall be

6 implemented to the extent possible, but shall not include the following

7 services when provided to enrollable Medicaid beneficiary populations:

8             (1) Nonemergency medical transportation in a capitated program;

9             (2) Dental benefits in a capitated program, not including

10 sedation dentistry;

11            (3) School-based services provided by school employees;

12            (4) Skilled nursing facility services;

13            (5) Assisted living facility services;

14            (6) Human development center services; or

15            (7) Waiver services provided to adults with physical

16 disabilities through the ARChoices in Homecare program or the Arkansas

17 IndependentChoices program.

19  SECTION 4. Arkansas Code � 20-77-2706(f)(3), concerning the

20 characteristics and duties of a risk-based provider organization under the

21 Medicaid Provider-Led Organized Care Act, is amended to read as follows:

22            (3)(A) Process claims, including medical claims and dental

23 claims for sedation dentistry, or otherwise ensure payment to direct service

24 providers within time frames established under federal regulations for goods

25 and services delivered to the enrollable Medicaid beneficiary populations.

26                  (B) Services provided by a risk-based provider

27 organization shall include medical and dental coverage for sedation dentistry

28 services;
