11  AN ACT TO AMEND THE LAW CONCERNING CRUELTY TO

12  ANIMALS; TO CREATE THE DOG AND CAT RESCUE ACT:

13  DAISY'S LAW; TO AUTHORIZE LAW ENFORCEMENT OFFICERS TO

14  SECURE A DOG OR CAT IN CERTAIN CIRCUMSTANCES; AND FOR

15  OTHER PURPOSES.

19                       TO CREATE THE DOG AND CAT RESCUE ACT:

20                       DAISY'S LAW.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24  SECTION 1. DO NOT CODIFY. Title.

25  This act shall be known and may be cited as the "Dog and Cat Rescue

26 Act: Daisy's Law".

28  SECTION 2. Arkansas Code Title 5, Chapter 62, Subchapter 1, is amended

29 to add an additional section to read as follows:

30  5-62-128. Law enforcement securing dogs and cats.

31  (a) In addition to the disposition of a dog or cat provided under � 5-

32 62-106, following a complaint of cruelty to dogs or cats under this

33 subchapter, a law enforcement officer may temporarily secure a dog or cat and

34 transfer temporary possession of the dog or cat to an appropriate place of

35 custody if a substantial likelihood exists that the condition of the dog or

36 cat would deteriorate if the dog or cat was not secured by the law

1 enforcement officer.

2   (b) A law enforcement officer may use the condition or the securing of

3 other dogs or cats belonging to the same owner as evidence to support

4 securing the dog or cat under subsection (a) of this section.
