9   AN ACT TO PROVIDE CURRICULUM TRANSPARENCY FOR PARENTS

10  OF KINDERGARTEN THROUGH GRADE TWELVE STUDENTS; TO

11  REQUIRE THE DIVISION OF ELEMENTARY AND SECONDARY

12  EDUCATION TO CREATE AN ONLINE PORTAL FOR PARENTS,

13  FACULTY, AND STAFF TO ACCESS SCHOOL INSTRUCTIONAL

14  MATERIALS; TO ALLOW A PARENT TO REVIEW AND OPT OUT OF

15  SELECTED LIBRARY MEDIA MATERIALS FOR HIS OR HER

16  CHILD; AND FOR OTHER PURPOSES.

27 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

29  SECTION 1. Arkansas Code � 6-16-103 is amended to read as follows:

30  6-16-103. Course of study generally -- Online portal required --

31 Definitions.

32  (a) There shall be taught in all of the public or elementary schools

33 of in this state subjects that may be designated by the State Board of

34 Education or as required by law.

35  (b) Nothing in this section shall be construed to prohibit the

36 inclusion of additional subjects in the state course of study or in any

1 course formulated for a school district and approved by the state board.

2   (c)(1) The Division of Elementary and Secondary Education shall

3 establish and maintain a statewide, centralized, easily accessible online

4 portal for parents, school faculty, and school staff to access instructional

5 materials, if funding is available.

6              (2) The portal required by subdivision (c)(1) of this section

7 shall provide curriculum transparency that enables a parent to:

8                   (A) Search and view instructional materials that are

9 searchable by district, school, and grade level;

10                  (B) Review summaries of the content of each textbook used

11 by a district;

12                  (C) Search and view the full content of each textbook used

13 by a district;

14                  (D) Search and view library media materials used by each

15 school in a district; and

16                  (E) Review a school's library media materials and opt out

17 his or her child from accessing library media materials the parent does not

18 wish to be available for his or her child.

19             (3) The portal required by subdivision (c)(1) of this section

20 shall enable a school administrator, school faculty member, and school staff

21 member to:

22                  (A) Have uniform access to Arkansas school standards in a

23 single repository to ensure transparency and reduce ambiguity; and

24                  (B) Reduce school employee workload by placing all

25 instructional materials in a centralized, searchable database.

26             (4) The portal required by subdivision (c)(1) of this section

27 shall enable a school administrator to comply with changing rules and

28 requirements by creating a database that contains school policies and

29 automatically updates based on changing rules and requirements.

30  (d) As used in this section:

31             (1) "District" means an Arkansas public kindergarten through

32 grade twelve (K-12) school district;

33             (2) "Instructional material" means a textbook, workbook, library

34 book, a library media material, a laboratory material, computer software,

35 video, or tape;

36             (3) "Library media material" means print and nonprint material

1 that is collected, processed, and stored by a school library media center and

2 that is available for student use;

3   (4) "Parent" means a parent, legal guardian, or person standing

4 in loco parentis to a child; and

5   (5) "School" means a public kindergarten through grade twelve

6 (K-12) school within a district.

8   SECTION 2. DO NOT CODIFY. Implementation.

9   The Division of Elementary and Secondary Education shall provide the

10 portal required under � 6-16-103(c) no later than January 15, 2026, if

11 funding is available.
