9               AN ACT TO AMEND THE ARKANSAS HEALTH CARE CONSUMER

10              ACT; TO REDUCE THE TIME ALLOWED FOR PROCESSING AN

11              APPLICATION OF A PROVIDER; AND FOR OTHER PURPOSES.

15                       TO AMEND THE ARKANSAS HEALTH CARE

16                       CONSUMER ACT; AND TO REDUCE THE TIME

17                       ALLOWED FOR PROCESSING AN APPLICATION OF

18                       A PROVIDER.

20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22  SECTION 1. Arkansas Code � 23-99-411(a)(2)(A), concerning the number

23 of days a healthcare insurer is provided to make a decision on an application

24 of a provider under the Arkansas Health Care Consumer Act, is amended to read

25 as follows:

26              (2)(A) Healthcare insurers A healthcare insurer shall make a

27 decision within:

28                               (i) Sixty (60) calendar days from the date of

29 submission of a completed application as defined by rule of the Insurance

30 Commissioner for participation or a request for renewal by a physician

31 licensed under the Arkansas Medical Practices Act, � 17-95-201 et seq., � 17-

32 95-301 et seq., and � 17-95-401 et seq.; and

33                               (ii) One hundred eighty (180) ninety (90) calendar

34 days from the date of submission of a completed application as defined by

35 rule of the commissioner for participation or a request for renewal by any

36 other provider.
