11           TERMINATED OR ABORTED IF CERTAIN CIRCUMSTANCES ARE

12           MET; AND FOR OTHER PURPOSES.

18                       WHICH A PREGNANCY IS TERMINATED OR

19                       ABORTED IF CERTAIN CIRCUMSTANCES ARE

20                       MET.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24  SECTION 1. Arkansas Code � 20-9-302, concerning abortion clinics and

25 health centers, is amended to add an additional subsection to read as

26 follows:

27  (j)(1) A clinic, health center, or other facility in which a pregnancy

28 of a woman known to be pregnant is willfully terminated or aborted in any

29 gestational age, including nonsurgical abortions, shall be licensed by the

30 department under this section.

31           (2) A clinic, health center, or other facility licensed under

32 subdivision (j)(1) of this section shall meet all requirements for licensure

33 as an ambulatory surgery center.

35  SECTION 2. Contingent effective date.

36  Section 1 of this act shall become effective only upon the

1 certification by the Attorney General that:

2   (1) The State of Arkansas is enjoined from preventing a person

3 from purposely performing or attempting to perform an abortion except to save

4 the life of a pregnant woman in a medical emergency under Arkansas Human Life

5 Protection Act, � 5-61-301 et seq., or the Arkansas Unborn Child Protection

6 Act, � 5-61-401 et seq.; or

7   (2) The Arkansas Human Life Protection Act, � 5-61-301 et seq.,

8 or the Arkansas Unborn Child Protection Act, � 5-61-401 et seq., have been

9 repealed or amended in whole or in part to allow a person to purposely

10 perform or attempt to perform an abortion except to save the life of a

11 pregnant woman in a medical emergency.
