16 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

18 SECTION 1. Arkansas Code Title 2, Chapter 1, Subchapter 1, is amended
19 to add an additional section to read as follows:
20 2-1-103. Vegetable garden protection -- Definition.
21 (a) As used in this section, "vegetable garden" means a plot of ground
22 or an elevated soil bed on residential property where vegetables, herbs,
23 fruits, flowers, pollinator plants, leafy greens, or other edible plants are
24 cultivated.
25 (b) The General Assembly intends to encourage and protect the
26 development of sustainable cultivation of vegetables and fruits at all levels
27 of production, including without limitation on residential property for
28 personal consumption or noncommercial sharing, as an important interest of
29 the state.
30 (c) A person may cultivate a vegetable garden on his or her own
31 private property or on the private property of another person with the
32 permission of the owner in any county, municipality, or other political
33 subdivision of this state.
34 (d)(1) A county, municipality, or other political subdivision of this
35 state shall not adopt an ordinance or regulation that prohibits a vegetable
36 garden on residential properties.

1 (2) Subdivision (d)(1) of this section does not prohibit the
2 adoption of a local ordinance or regulation that regulates certain specifics
3 impacting vegetable gardens, including without limitation the use of water
4 during drought conditions, fertilizer use, control of invasive species and
5 weeds, and reasonable size and location specifics related to permissible
6 vegetable garden locations including without limitation side yards or
7 backyards.
