20 AUTHORIZE THE ISSUANCE OF A TEMPORARY
21 SPECIAL CERTIFICATE TO PREGNANT WOMEN.

23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

25 SECTION 1. Arkansas Code Title 27, Chapter 15, Subchapter 3, is
26 amended to add an additional section to read as follows:
27 27-15-318. Pregnancy Parking Act -- Temporary special certificate
28 during and after pregnancy.
29 (a) This act shall be known and may be cited as the "Pregnancy Parking
30 Act".
31 (b) A woman who is pregnant, as determined by a licensed physician,
32 may apply to the Office of Motor Vehicle for a temporary person-with-a-
33 disability special certificate.
34 (c) The temporary special certificate shall:
35 (1) Conform to the requirements under � 27-15-304(a)-(c); and
36 (2) Expire one (1) year following the date the pregnant woman

1 gives birth.
2 (d) The Office of Motor Vehicles shall:
3 (1) Develop an appropriate form, including a provision for a
4 sworn statement of pregnancy, for use by an applicant to request issuance of
5 the temporary special person-with-a-disability certificate for a pregnant or
6 post-partum woman;
7 (2) Distribute a copy of this subchapter to all appropriate law
8 enforcement agencies charged with enforcement of the Motor Vehicle Code;
9 (3) Adopt procedures and promulgate rules to advise and inform
10 the general public of the provisions of this subchapter and the availability
11 of the temporary special certificates;
12 (4) Maintain accurate records of the annual number of temporary
13 special certificates issued and in inventory;
14 (5) Enter into the permanent record of each applicant, the
15 temporary special certificate number, and type of allowable disability of the
16 applicant in a manner that will allow retrieval of the information for
17 statistical use; and
18 (6) Include a notice with each application for a temporary
19 special certificate informing the applicant and any other person driving for
20 the applicant of the requirements of this subchapter and further informing
21 the applicant that the privilege to park in spaces reserved for persons with
22 disabilities shall be available only when the person for whom the temporary
23 special certificate was issued or a person with a disability is actually in
24 the vehicle.
25 (e) The Office of Motor Vehicle may promulgate rules to administer the
26 provisions of this section.
