12  LANDFILL IS LOCATED; TO REQUIRE RENEWAL OR

13  RENEGOTIATION OF THE HOST FEE WITHIN A CERTAIN PERIOD

14  OF TIME; AND FOR OTHER PURPOSES.

24 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

26  SECTION 1. Arkansas Code Title 8, Chapter 6, Subchapter 6, is amended

27 to add an additional section to read as follows:

28  8-6-609. Host fee.

29  (a) As used in this section, "host community" means the county and

30 city in which the proposed, current, or expanded site of the solid waste

31 landfill is located.

32  (b)(1) An agreement or contract for a host fee shall not exceed a

33 contract term of four (4) years ending in December of even-numbered years.

34 (2) The agreement or contract for a host fee may be renewed for an additional

35 term not to exceed four (4) years at the same amount of the host fee or

36 renegotiated for a new amount of the host fee.

1   (3) This section does not limit the times that an agreement or

2 contract for a host fee may be renewed.

3   (4) Any contract or agreement for a host fee:

4   (A) Shall have a beginning date and an end date or an

5 extension date; and

6   (B) Shall not have the host fee as a provision in

7 perpetuity within the contract or agreement.

8   (c) The agreement or contract for a host fee shall be voted on at a

9 regularly scheduled meeting of the host community and signed by either the

10 mayor of the city or the county judge if a municipality is not the closest

11 governmental unit.
