17 THE DISPOSAL OF INDUSTRIAL WASTE IN AN
18 AGRICULTURAL OR PASTORAL APPLICATION FOR
19 A CERTAIN NUMBER OF VIOLATIONS.

21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

23 SECTION 1. Arkansas Code � 8-4-103, concerning criminal, civil, and
24 administrative penalties under the Arkansas Water and Air Pollution Control
25 Act, is amended to add an additional subsection to read as follows:
26 (m)(1) If a person permitted to manage industrial wastewater residuals
27 by land application violates a permit issued under this subchapter resulting
28 in an over-application or a precipitation related surface land application,
29 the Division of Environmental Quality shall assess the maximum allowable
30 penalty as identified in subsection (c) of this section for each violation.
31 (2) As used in this subsection, "surface land application" means
32 the spraying, spreading, or incorporating of waste into or onto the land,
33 excluding injection of waste into the land.

35 SECTION 2. DO NOT CODIFY. Land application of industrial wastewater
36 residuals rule.

1 (a) The Arkansas Pollution Control and Ecology Commission shall begin
2 the process to promulgate a rule to authorize no-discharge land application
3 permits of industrial waste.
4 (b) Until the rule described under subsection (a) of this section is
5 effective, the Division of Environmental Quality shall continue the same
6 processes and procedures regarding land application permits.
