9   AN ACT TO INCREASE FISCAL RESPONSIBILITY THROUGH THE

10  ESTABLISHMENT OF INCOME LIMITS FOR STUDENTS ELIGIBLE

11  FOR EDUCATIONAL FREEDOM ACCOUNTS IN THE 2025-2026

12  SCHOOL YEAR AND THEREAFTER; AND FOR OTHER PURPOSES.

16                       TO INCREASE FISCAL RESPONSIBILITY

17                       THROUGH THE ESTABLISHMENT OF INCOME

18                       LIMITS FOR STUDENTS ELIGIBLE FOR

19                       EDUCATIONAL FREEDOM ACCOUNTS IN THE

20                       2025-2026 SCHOOL YEAR AND THEREAFTER.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

23

24  SECTION 1. Arkansas Code � 6-18-2506(a)(3)(A)(i)(e)-(g), concerning

25 student eligibility for the Arkansas Children's Educational Freedom Account

26 Program, is amended to read as follows:

27                              (e) A child of active-duty uniformed service

28 personnel, as identified under Title 10, Title 32, Title 33, or Title 42 of

29 the United States Code; or

30                              (f) A student who was enrolled in the previous

31 school year in a:

32                              (1) Public school that has a rating of

33 "F" under �� 6-15-2105 and 6-15-2106 and State Board of Education rules; or

34                              (2) Public school district classified as

35 in need of Level 5 -- Intensive support under � 6-15-2913 or � 6-15-2915; or

36                              (g) A student who is enrolling in kindergarten

1 for the first time.

3          SECTION 2. Arkansas Code � 6-18-2506(a)(3)(C) is amended to read as

4 follows:

5                  (C)(i) For the 2025-2026 school year and each year

6 thereafter, any resident of this state who is eligible to enroll in a public

7 elementary or secondary school shall be eligible student eligibility shall

8 include students who meet at least one (1) of the following:

9                        (i) A student who is eligible under subdivision

10 (a)(3)(B)(i) of this section;

11                       (ii) A student who is continuing to participate in

12 the Arkansas Children's Educational Freedom Account Program from the 2024-

13 2025 school year; or

14                       (iii) A resident of this state who is eligible to

15 enroll in a public elementary or secondary school if:

16                                (a) His or her family has a gross family

17 income not exceeding two hundred fifty percent (250%) of the federal poverty

18 level;

19                                (b)(1) His or her family has a gross family

20 income exceeding two hundred fifty percent (250%) of the federal poverty

21 level but not exceeding three hundred fifty percent (350%) of the federal

22 poverty level.

23                                (2) However, a student eligible for an

24 account under subdivision (a)(3)(C)(iii)(b)(1) of this section shall receive

25 only fifty percent (50%) of the prior year's statewide foundation funding

26 allocated per student under � 6-20-2305; or

27                                (c)(1) His or her family has a gross family

28 income exceeding three hundred fifty percent (350%) of the federal poverty

29 level but not exceeding four hundred percent (400%) of the federal poverty

30 level.

31                                (2) However, a student eligible for an

32 account under subdivision (a)(3)(C)(iii)(c)(1) of this section shall receive

33 only twenty-five percent (25%) of the prior year's statewide foundation

34 funding allocated per student under � 6-20-2305.

35                       (ii) Beginning with the 2025-2026 school year, there

36 shall be no limitation on student participation in the Arkansas Children's
