9   AN ACT TO AMEND THE LAW CONCERNING THE OFFICE OF

10  SHERIFF; TO AMEND THE LAW CONCERNING COMPENSATION FOR

11  THE OFFICE OF SHERIFF; AND FOR OTHER PURPOSES.

17                       CONCERNING COMPENSATION FOR THE OFFICE

18                       OF SHERIFF.

20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

21

22  SECTION 1. Arkansas Code Title 14, Chapter 14, Subchapter 12, is

23 amended to add an additional section to read as follows:

24  14-14-1214. Compensation of sheriffs.

25  (a) A quorum court shall fix by ordinance the annual salary of the

26 sheriff as provided under � 14-14-1204 subject to the adjustments provided by

27 � 14-14-1210 or otherwise provided by law.

28  (b) If an individual elected or appointed to the office of sheriff

29 does not have the training or experience provided under � 14-14-1315(a)(1) or

30 � 14-14-1315(a)(2) as documented on the filing required under � 14-14-1315,

31 the quorum court shall fix by ordinance the annual salary of the sheriff at

32 the minimum provided by � 14-14-1204, subject to the adjustments provided by

33 � 14-14-1210.

35  SECTION 2. Arkansas Code Title 14, Chapter 14, Subchapter 13, is

36 amended to add an additional section to read as follows:

1   14-14-1315. Required documentation for newly elected or appointed

2 sheriffs.

3   (a) Within ten (10) days of his or her election or appointment, an

4 individual elected or appointed to the office of sheriff shall file

5 documentation with the county clerk that the individual:

6               (1) Is in compliance with the selection and training

7 requirements for certification set by and documented by the Arkansas Law

8 Enforcement Training Academy;

9               (2) Is eligible to be employed as a law enforcement officer

10 under � 12-9-112; or

11              (3) Does not have the training or experience provided under

12 subdivision (a)(1) or subdivision (a)(2) of this section.

13  (b) The county clerk shall provide copies of the documentation

14 required under subsection (a) of this section to the quorum court before the

15 individual elected or appointed to the office of sheriff takes office.

16  (c)(1) An individual elected or appointed to the office of sheriff

17 that subsequently meets the training or experience under subdivision (a)(1)

18 or subdivision (a)(2) of this section may file documentation of the training

19 or experience with the county clerk.

20              (2) The county clerk shall provide copies of the documentation

21 submitted under subdivision (c)(1) of this section to the quorum court, which

22 may be considered when the quorum court is determining compensation under �

23 14-14-1214.

25  SECTION 3. DO NOT CODIFY. Effective date. This act is effective on

26 and after December 31, 2026.
