12 MATERIAL, OR COMMUNICATION DIRECTED TO THE PUBLIC;

17 TO PROHIBIT A SCHOOL FROM USING OR
18 REFERENCING A PUBLIC SCHOOL RATING IN
19 ANY ADVERTISING, PROMOTIONAL MATERIAL,
20 OR COMMUNICATION DIRECTED TO THE PUBLIC.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24 SECTION 1. Arkansas Code � 6-15-2105, concerning the publication of a
25 public school's rating by the Division of Elementary and Secondary Education,
26 is amended to add an additional subsection to read as follows:
27 (c)(1) No school shall use or reference a public school rating of
28 another school that is published by the division under this subchapter in any
29 advertising, promotional material, or communication the school directs to the
30 public.
31 (2) As used in subdivision (c)(1) of this section, "school"
32 means a public school district, an open-enrollment public charter school, or
33 a private school.
