15               AN ACT TO PROHIBIT LOBBYING FOR A COVERED FOREIGN

16               ENTITY; AND FOR OTHER PURPOSES.

20                         TO PROHIBIT LOBBYING FOR A COVERED

21                         FOREIGN ENTITY.

23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

25  SECTION 1. Arkansas Code Title 21, Chapter 8, Subchapter 6, is amended

26 to add an additional section to read as follows:

27  21-8-608. Lobbying for covered foreign entity prohibited ---- Definition

28 ---- Penalties.

29  (a) As used in this section:

30               (1) "Covered foreign entity" means an individual, foreign

31 government, or a party other than an individual or foreign government:

32                         (A) On the Consolidated Screening List or Entity List as

33 designated by the United States Secretary of Commerce;

34                         (B) Domiciled in the People's Republic of China or the

35 Russian Federation;

36                         (C) Under the influence or control by the government of

1 the People's Republic of China or the Russian Federation; or

2                     (D) That is a subsidiary of an individual, government, or

3 party referred to in subdivisions (a)(1)(A)-(C) of this section; and

4         (2) "Under the influence or control" means the People's Republic

5 of China, the Russian Federation, or an agent of the People's Republic of

6 China or the Russian Federation is:

7                     (A) Exercising power or authority to regulate decisions

8 over the covered foreign entity; or

9                     (B) Governing, managing, directing, or otherwise

10 overseeing decision making for the covered foreign entity.

11        (b) A person who receives a monetary benefit for lobbying shall not

12 lobby on behalf of a covered foreign entity.

13        (c) A person convicted of violating subsection (b) of this section

14 shall be guilty of:

15        (1) For the first offense, a violation with a fine of not less

16 than fifty dollars ($50.00) and not more than three thousand five hundred

17 dollars ($3,500);

18        (2) For the second offense, an unclassified misdemeanor with:

19                    (A) A term of imprisonment not to exceed fix (6) months;

20                    (B) A fine of five thousand dollars ($5,000); or

21                    (C) Both the term of imprisonment and fine under

22 subdivisions (c)(2)(A) and (B) of this section; and

23        (3) For the third or subsequent offense, an unclassified felony

24 with:

25                    (A) A term of imprisonment not to exceed one (1) year;

26                    (B) A fine of ten thousand dollars ($10,000); or

27                    (C) Both the term of imprisonment and fine under

28 subdivisions (c)(3)(A) and (B) of this section.
