10 CREATE THE OFFENSE OF HARBORING ILLEGAL IMMIGRANTS;

15 TO CREATE THE OFFENSE OF HUMAN
16 SMUGGLING; AND TO CREATE THE OFFENSE OF
17 HARBORING ILLEGAL IMMIGRANTS.

19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

21 SECTION 1. Arkansas Code Title 5 is amended to add an additional chapter to
22 read as follows:
23 CHAPTER 80 -- IMMIGRATION
24 5-80-101. Human smuggling.
25 (a) A person commits the offense of human smuggling if he or she
26 knowingly transports into the state an individual whom the person knows, or
27 reasonably should know, has entered the United States in violation of law and
28 has not been inspected by the United States Government since his or her
29 unlawful entry from another country.
30 (b) A person commits a separate offense for each individual he or she
31 transports into this state in violation of this section.
32 (c) Human smuggling is a:
33 (1) Class C felony for a second or subsequent offense under
34 subdivision (c)(2) of this section;
35 (2) Class D felony if the person receives anything of value in
36 return for the commission of the offense; or

1 (3) Class A misdemeanor if otherwise committed.
2 (d) This section does not restrict or prevent a school or an
3 institution of higher education from providing housing services to any
4 regularly enrolled student.
5 5-80-102. Harboring illegal immigrants.
6 (a) A person commits the offense of harboring illegal immigrants if he
7 or she knowingly conceals, harbors, or shields from detection an individual
8 whom the person knows, or reasonably should know, has entered the United
9 States in violation of law and has not been inspected by the United States
10 Government since his or her unlawful entry from another country.
11 (b) A person commits a separate offense for each individual he or she
12 harbors in violation of this section.
13 (c) Harboring illegal immigrants is a:
14 (1) Class C felony for a second or subsequent offense under
15 subdivision (c)(2) of this section;
16 (2) Class D felony if a person receives anything of value in
17 return for the commission of the offense; or
18 (3) Class A misdemeanor if otherwise committed.
19 (d) This section does not restrict or prevent a school or an
