22 FOR RESPIRATORY SYNCYTIAL VIRUS DISEASE;
23 AND TO PROVIDE CIVIL IMMUNITY.

25 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

27 SECTION 1. Arkansas Code Title 20, Chapter 77, Subchapter 4, is
28 amended to add an additional section to read as follows:
29 20-77-408. Administrative fees for immunizations and monoclonal
30 antibodies for respiratory syncytial virus disease -- Definition.
31 (a) As used in this section, "respiratory syncytial virus disease"
32 means a respiratory infection of the nose, throat, and lungs caused by the
33 respiratory syncytial virus.
34 (b) The Arkansas Medicaid Program shall reimburse an administration
35 fee that is equal to one hundred percent (100%) of the maximum administration
36 fee of the Vaccines for Children Program for this state for administration of

1 an immunization or monoclonal antibody used for long-lasting protection from
2 respiratory syncytial virus disease in infants and toddlers, regardless of
3 the category in which the beneficiary receiving the immunization or
4 monoclonal antibody is enrolled, including without limitation the Medicaid
5 Provider-Led Organized Care Act, � 20-77-2701 et seq.
6 (c) This section does not require a hospital licensed under � 20-9-213
7 to provide any new or additional service related to administering the
8 immunization or monoclonal antibody used for long-lasting protection from
9 respiratory syncytial virus disease in infants and toddlers.
10 (d) The Department of Human Services shall apply for any federal
11 waiver, Medicaid state plan amendment, or other authority necessary to
12 implement this section.

14 SECTION 2. Arkansas Code Title 16, Chapter 114, Subchapter 2, is
15 amended to add an additional section to read as follows:
16 16-114-214. Immunity related to administration of immunization or
17 monoclonal antibody used for long-lasting protection from respiratory
18 syncytial virus disease -- Definition.
19 (a) As used in this section, "respiratory syncytial virus disease"
20 means a respiratory infection of the nose, throat, and lungs caused by the
21 respiratory syncytial virus.
22 (b)(1) A person or entity that prescribes, dispenses, administers, or
23 is otherwise involved in the administration of an immunization or monoclonal
24 antibody used for long-lasting protection from respiratory syncytial virus
25 disease in infants and toddlers to an eligible patient is immune from civil
26 liability.
27 (2) A person or entity is not immune from civil liability for
28 actions taken during the administration of an immunization or monoclonal
29 antibody that:
30 (A) Are grossly negligent, reckless, or willful; or
31 (B) Are not taken in good faith and with reasonable care.
