9   AN ACT TO AMEND THE LAW CONCERNING THE MANAGEMENT OF

10  PUBLIC RECORDS AND ARCHIVES; TO REQUIRE APPROVAL OF

11  THE ARKANSAS STATE ARCHIVES PRIOR TO THE DESTRUCTION

12  OF CERTAIN DOCUMENTS; AND FOR OTHER PURPOSES.

16                       TO AMEND THE LAW CONCERNING THE

17                       MANAGEMENT OF PUBLIC RECORDS AND

18                       ARCHIVES; AND TO REQUIRE APPROVAL OF THE

19                       ARKANSAS STATE ARCHIVES PRIOR TO THE

20                       DESTRUCTION OF CERTAIN DOCUMENTS.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24  SECTION 1. Arkansas Code � 13-4-204(a), concerning destruction of an

25 original document, is amended to read as follows:

26  (a) When any document is recorded by the means prescribed by � 13-4-

27 201, the paper original may be destroyed unless the document is over fifty

28 (50) years old and handwritten or and has been determined to be of historical

29 value by the Arkansas State Archives.

31  SECTION 2. Arkansas Code � 13-4-301(b)(1), concerning retention and

32 destruction of county records, is amended to read as follows:

33  (b)(1) If a record is photographically or electronically transferred

34 to other media of a permanent nature, the original documents may be

35 destroyed, except that no handwritten records over fifty (50) years old shall

36 be destroyed without the consultation and approval of the Arkansas State
