27 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

29 SECTION 1. Arkansas Code � 19-11-1401 is amended to read as follows:
30 19-11-1401. Title.
31 This subchapter shall be known and may be cited as the "Construction
32 Manager-General Contractor Method of Procurement Pilot Program".

34 SECTION 2. Arkansas Code � 19-11-1404 is amended to read as follows:
35 19-11-1404. Construction Manager-General Contractor Method of
36 Procurement Pilot Program -- Creation.

1 (a) The State Highway Commission may develop a Construction Manager-
2 General Contractor Method of Procurement Pilot Program to test the
3 utilization of the construction manager-general contractor method as a cost-
4 effective option for constructing transportation projects.
5 (b)(1)(A) For the first phase of the program, the commission may
6 select a total of five (5) transportation projects on which to utilize the
7 construction manager-general contractor method.
8 (B)(i) The sum of the construction cost estimates prepared
9 as required under � 19-11-1407 of all five (5) construction manager-general
10 contractor method transportation projects selected under subdivision
11 (b)(1)(A) of this section shall not exceed two hundred million dollars
12 ($200,000,000).
13 (ii) A construction cost estimate of a construction
14 manager-general contractor method transportation project selected under
15 subdivision (b)(1)(A) of this section shall not exceed one hundred million
16 dollars ($100,000,000).
17 (2)(A) For the second phase of the program, beginning on August
18 1, 2023, the commission may select a total of five (5) additional
19 transportation projects that are not currently in the procurement process on
20 which to utilize the construction manager-general contractor method.
21 (B)(i) The sum of the construction cost estimates prepared
22 as required under � 19-11-1407 of all five (5) construction manager-general
23 contractor method transportation projects selected under subdivision
24 (b)(2)(A) of this section shall not exceed five hundred million dollars
25 ($500,000,000).
26 (ii) A construction cost estimate of a construction
27 manager-general contractor method transportation project selected under
28 subdivision (b)(2)(A) of this section shall not exceed one hundred fifty
29 million dollars ($150,000,000).
30 (c) The Director of State Highways and Transportation shall send
31 written notice identifying the transportation project and the reasons for
32 deciding to apply the construction manager-general contractor method to that
33 specific transportation project to:
34 (1) The Chair of the House Committee on Public Transportation;
35 and
36 (2) The Chair of the Senate Committee on Public Transportation,

1 Technology, and Legislative Affairs.
2 (d) The program established under this subchapter shall terminate no
3 later than June 30, 2026.
4 (b) The commission may use the Construction Manager-General Contractor
5 Method of Procurement Program for any transportation project for which the
6 construction cost estimate prepared under � 19-11-1407 does not exceed three
7 hundred million dollars ($300,000,000).

9 SECTION 3. Uncodified Acts 2023, No. 823, � 3, is repealed.
10 SECTION 3. DO NOT CODIFY. Study of benefits and costs.
11 (a) The Director of the Arkansas Department of Transportation shall
12 provide an independent consultant study that compares the benefits and costs
13 for projects using the construction manager-general contractor method of
14 procurement versus the traditional design build delivery method of
15 procurement.
16 (b) The study required under subsection (a) of this section shall be
17 submitted to the Arkansas Legislative Audit for review.
