16         CONTRACTS BY STATE AGENCIES; TO PROHIBIT THE USE OF

17         PUBLIC FUNDS BY STATE AGENCIES TO PURCHASE

18         PROMOTIONAL ITEMS MADE IN CHINA; AND FOR OTHER

19         PURPOSES.

23                         TO AMEND THE LAW CONCERNING PROHIBITED

24                         CONTRACTS BY STATE AGENCIES; AND TO

25                         PROHIBIT THE USE OF PUBLIC FUNDS BY

26                         STATE AGENCIES TO PURCHASE PROMOTIONAL

27                         ITEMS MADE IN CHINA.

29 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

31         SECTION 1. Arkansas Code � 25-1-1202, concerning the definitions for

32 the laws on prohibited contracts by state agencies, is amended to add

33 additional subdivisions to read as follows:

34         (5) "Promotional items" means one (1) or more items purchased by

35 a state agency with public funds to promote or advertise the agency,

36 including without limitation a:

1            (A) Bumper sticker;

2            (B) Clothing item;

3            (C) Key chain;

4            (D) Mug;

5            (E) Pen; or

6            (F) Pin;

7            (6) "Public funds" means the same as defined in � 19-11-203;

9   SECTION 2. Arkansas Code Title 25, Chapter 1, Subchapter 12, is

10 amended to add an additional section to read as follows:

11  25-1-1204. Promotional items made in China prohibited.

12  A state agency shall not spend public funds to purchase promotional

13 items made in the People's Republic of China.

15  SECTION 3. DO NOT CODIFY. The name of Arkansas Code Title 25, Chapter

16 1, Subchapter 12 is changed from "Prohibited Contracts by State Agencies" to

17 "Prohibited Actions by State Agencies." The Arkansas Code Revision Commission

18 shall make all changes in the Arkansas Code necessary to implement this

19 section.

21  SECTION 4. DO NOT CODIFY. Applicability.

22  Sections 1 and 2 of this act apply only to contracts executed on or

23 after the effective date of this act.
