9              AN ACT CONCERNING THE ANY WILLING PROVIDER LAWS; TO

10             AMEND THE PATIENT PROTECTION ACT OF 1995; AND FOR

11             OTHER PURPOSES.

15                       CONCERNING THE ANY WILLING PROVIDER

16                       LAWS; AND TO AMEND THE PATIENT

17                       PROTECTION ACT OF 1995.

19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

20

21  SECTION 1. Arkansas Code � 23-99-203(d), concerning the definition of

22 "healthcare provider" under the Patient Protection Act of 1995, is amended to

23 read as follows:

24  (d) "Healthcare provider" means those individuals or entities licensed

25 by the State of Arkansas to provide healthcare services, limited to the

26 following:

27             (1) Advanced practice nurses;

28             (2) Athletic trainers;

29             (3) Audiologists;

30             (4) Certified behavioral health providers;

31             (5) Certified orthotists;

32             (6) Chiropractors;

33             (7) Community mental health centers or clinics;

34             (8) Dentists;

35             (9) Home health care;

36             (10) Hospice care;

1   (11) Hospital-based services;

2   (12) Hospitals;

3   (13) Licensed ambulatory surgery centers;

4   (14) Licensed certified social workers;

5   (15) Licensed dieticians;

6   (16) Licensed intellectual and developmental disabilities

7 service providers;

8   (17) Licensed professional counselors;

9   (18) Licensed psychological examiners;

10  (19) Long-term care facilities;

11  (20) Occupational therapists;

12  (21) Optometrists;

13  (22) Pharmacists and pharmacies;

14  (23) Physical therapists;

15  (24) Physicians and surgeons (M.D. and D.O.);

16  (25) Podiatrists;

17  (26) Prosthetists;

18  (27) Psychologists;

19  (28) Respiratory therapists;

20  (29) Rural health clinics; and

21  (30) Speech pathologists.

23  SECTION 2. Arkansas Code � 23-99-802(4), concerning the definition of

24 "healthcare provider" as used under the any willing provider laws, is amended

25 to read as follows:

26  (4) "Healthcare provider" or "provider" means those individuals

27 or entities licensed by the State of Arkansas to provide healthcare services,

28 limited to the following:

29  (A) Advanced practice nurses;

30  (B) Athletic trainers;

31  (C) Audiologists;

32  (D) Certified behavioral health providers;

33  (E) Certified orthotists;

34  (F) Chiropractors;

35  (G) Community mental health centers or clinics;

36  (H) Dentists;

1   (I) Home health care;

2   (J) Hospice care;

3   (K) Hospital-based services;

4   (L) Hospitals;

5   (M) Licensed ambulatory surgery centers;

8   (P) Licensed durable medical equipment providers;

9   (Q) Licensed intellectual and developmental disabilities

10 service providers;

11  (R) Licensed professional counselors;

12  (S) Licensed psychological examiners;

13  (T) Long-term care facilities;

14  (U) Occupational therapists;

15  (V) Optometrists;

16  (W) Pharmacists and pharmacies;

17  (X) Physical therapists;

18  (Y) Physicians and surgeons (M.D. and D.O.);

19  (Z) Podiatrists;

20  (AA) Prosthetists;

21  (BB) Psychologists;

22  (CC) Respiratory therapists;

23  (DD) Rural health clinics;

24  (EE) Speech pathologists; and

25  (FF) Other healthcare practitioners as determined by the

26 State Insurance Department in rules promulgated under the Arkansas

27 Administrative Procedure Act, � 25-15-201 et seq.;
