10      COUNTY PROPERTY ASSESSOR; TO PERMIT A PROPERTY OWNER

11      TO OPT OUT OF HAVING THE PROPERTY OWNER'S INFORMATION

12      POSTED ON AN ONLINE DATABASE; AND FOR OTHER PURPOSES.

16                       TO AMEND THE LAW CONCERNING THE DUTIES

17                       OF A COUNTY PROPERTY ASSESSOR; AND TO

18                       PERMIT A PROPERTY OWNER TO OPT OUT OF

19                       HAVING THE PROPERTY OWNER'S INFORMATION

20                       POSTED ON AN ONLINE DATABASE.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24      SECTION 1. DO NOT CODIFY. Legislative findings.

25      The General Assembly finds that:

26      (1) Records published online by county assessors are for the

27 convenience of a property owner;

28      (2) Online records afford a property owner the ability to pay

29 taxes and fees online;

30      (3) County assessors in Arkansas are not required by law to

31 publish records online however, certain records are available upon request;

32 and

33      (4) Property owners may desire to opt out of having their

34 records placed online for privacy or other reasons.

36      SECTION 2. Arkansas Code � 14-14-111(b), concerning county government

1 use of electronic records, is amended to add an additional subdivision to

2 read as follows:

3           (4) "Online database" means a website with administrative rights

4 retained by a county official that is used by members of the public to search

5 public records maintained by the office of the county official.

7   SECTION 3. Arkansas Code � 14-14-111, concerning county government use

8 of electronic records, is amended to add additional subsections to read as

9 follows:

10  (e)(1) A county assessor who maintains an online database for property

11 records shall allow a property owner to opt out of making the property

12 owner's information available on the online database.

13          (2) To opt out of having the property owner's information

14 included in the online database under subdivision (e)(1) of this section, the

15 property owner shall submit a request in writing to the county assessor

16 stating the property owner's intent to opt out of the online database.

17  (f) The Assessment Coordination Division may promulgate rules to

18 create and maintain the forms necessary to submit a request under subsection

19 (e) of this section.
