11           LIGHTING COMPONENTS FOR PUBLIC WORKS PROJECTS; AND

12           FOR OTHER PURPOSES.

18                       INFORMATION FOR LIGHTING COMPONENTS FOR

19                       PUBLIC WORKS PROJECTS.

21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

23  SECTION 1. Arkansas Code � 22-9-203, concerning the award procedure

24 for contracts for public improvements, is amended to add an additional

25 subsection to read as follows:

26  (n)(1) Except as otherwise provided in this subsection, the state, an

27 agency of the state, a county, a municipality, a school district, or other

28 local taxing unit shall not enter into a contract with a contractor that

29 includes a project designed by an electrical engineering firm unless the

30 design requires allowance for a three-bid specification by three (3) separate

31 lighting agencies.

32           (2) As used in this subsection, "lighting agency" means an

33 entity that represents one (1) or more lighting manufacturers for sale

34 through electrical distribution houses.

35           (3) This subsection does not apply to a municipal electric

36 utility.

1   (4) An architect or an electrical engineer may make an allowance

2 for a specialty fixture to be procured outside of the three-bid requirement

3 under subdivision (n)(1) of this section when circumstances warrant the

4 allowance because of design aesthetics or historical purposes, or both.
