9   AN ACT TO REPEAL THE PROHIBITION AGAINST THE SALE AND

10  DISTRIBUTION OF NOVELTY LIGHTERS; AND FOR OTHER

11  PURPOSES.

17                       LIGHTERS.

19 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

21  SECTION 1. Arkansas Code � 5-60-102 is repealed.

22  5-60-102. Prohibition on sales and distribution of novelty lighters.

23  (a)(1) As used in this section, "novelty lighter" means a product

24 commonly used by consumers to ignite cigarettes, cigars, pipes, gas grills,

25 or other combustible material that has entertaining audio or visual features

26 that depict or resemble in physical form or function articles commonly

27 recognized as appealing to or intended for use by children ten (10) years of

28 age or younger, including without limitation lighters that depict or resemble

29 cartoon characters, toys, guns, watches, musical instruments, vehicles, toy

30 animals, food, or beverages or that play musical notes or have flashing

31 lights or other entertaining features.

32  (2) "Novelty lighter" does not include:

33                        (A) A lighter manufactured before 1980; or

34                        (B) A lighter that lacks a device necessary to produce

35 combustion or a flame.

36  (b)(1) The retail sale, offer of retail sale, gift, or distribution of

1 any novelty lighter in Arkansas is prohibited.

2   (2) Subdivision (b)(1) of this section does not apply to a

3 novelty lighter that is:

4   (A) Being actively transported through the state; or

5   (B) Located in a warehouse closed to the public for

6 purposes of retail sales.

7   (c) A person who pleads guilty or nolo contendere to or is found

8 guilty of violating this section is guilty of a violation and shall be

9 punished by a fine of not less than twenty-five dollars ($25.00) nor more

10 than five hundred dollars ($500) for each offense and shall pay court costs.
