15 AT AN AIRPORT.

17 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

19 SECTION 1. Arkansas Code Title 14, Chapter 356, Subchapter 1, is
20 amended to add an additional section to read as follows:
21 14-356-103. Expedited security screening -- Definitions.
22 (a) As used in this section:
23 (1) "Airline" means an organization providing a regular public
24 service of commercial air transportation on one (1) or more routes;
25 (2) "Expedited security screening" means a service provided by a
26 vendor at a public airport that allows a person to use a standard security
27 lane or a United States Transportation Security Administration PreCheck
28 Program lane for the purpose of a security screening instead of the standard
29 security screening provided at the public airport;
30 (3)(A) "Public airport" means a tract of land or water owned by
31 a governmental entity with buildings and facilities for the landing, takeoff,
32 shelter, supply, and repair of aircraft.
33 (B) "Public airport" includes without limitation:
34 (i) Appurtenant areas used or intended to be used
35 for operations, maintenance, storage, or rights-of-way;
36 (ii) A county airport;

1 (iii) A municipal airport; and
2 (iv) A regional airport;
3 (4) "Public airport operator" means a person or entity that is
4 authorized to manage or run a public airport, including without limitation an
5 airport authority, fixed-base operator, or other agency; and
6 (5) "Vendor" means a private third-party vendor that provides an
7 expedited security screening.
8 (b) A public airport operator may enter into an agreement with a
9 vendor to provide an expedited security screening only if the vendor has
10 obtained a dedicated Transportation Security Administration security lane at
11 the public airport operated by the public airport operator exclusively to
12 provide an expedited security screening.
13 (c)(1) A public airport operator may enter into an agreement with an
14 airline to provide an expedited security screening offered by an airline for
15 exclusive use by passengers of the airline.
16 (2) An agreement between a public airport operator and an
17 airline to provide an expedited security screening for the exclusive use of
18 passengers of the airline shall not require a passenger using the expedited
19 security screening to pay an additional fee to a vendor.

21 Section 2. DO NOT CODIFY. Retroactivity.
22 This act applies retroactively to all agreements entered into by a
23 public airport operator on or after January 1, 2025.
