11        CERTAIN STUDENTS ENROLLED IN THE SCHOOL; AND FOR

12        OTHER PURPOSES.

16                       TO REQUIRE A PRIVATE SCHOOL THAT ACCEPTS

17                       STATE FUNDING OF ANY TYPE TO PROVIDE

18                       TRANSPORTATION TO CERTAIN STUDENTS

19                       ENROLLED IN THE SCHOOL.

21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

23        SECTION 1. Arkansas Code Title 6, Chapter 20, Subchapter 1, is amended

24 to add an additional section to read as follows:

25        6-20-108. Acceptance of state funds -- Transportation required.

26        (a) A private school that accepts state funding of any type shall

27 provide transportation for students who are enrolled in the private school

28 and live within thirty-five (35) miles of the private school.

29        (b) Transportation required to be provided by a private school under

30 subsection (a) of this section shall be covered in its entirety by the

31 private school.

32        (c) As used in this section, "private school" means a nonpublic school

33 that:

34        (1) Offers instruction for students in grades kindergarten

35 through twelve (K-12) in this state; and

36        (2) Receives any type of state funding in any amount.
