9   AN ACT CONCERNING MISSING PERSONS ALERTS; TO CODIFY

10  THE ARKANSAS AMBER ALERT SYSTEM; TO CODIFY THE

11  ARKANSAS SILVER ALERT SYSTEM; TO CREATE THE MISSING

12  ENDANGERED ADULT ADVISORY SYSTEM; AND FOR OTHER

13  PURPOSES.

17                       CONCERNING MISSING PERSONS ALERTS; TO

18                       CODIFY THE ARKANSAS AMBER ALERT SYSTEM;

19                       TO CODIFY THE ARKANSAS SILVER ALERT

20                       SYSTEM; AND TO CREATE THE MISSING

21                       ENDANGERED ADULT ADVISORY SYSTEM.

23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24

25  SECTION 1. Arkansas Code Title 12, Chapter 8, is amended to add an

26 additional subchapter to read as follows:

27                       Subchapter 7 - Missing Persons Alert Systems

28

29  12-8-701. Arkansas Amber Alert System.

30  (a) There is established the Arkansas Amber Alert System to be

31 administered by the Division of Arkansas State Police.

32  (b) The division shall:

33  (1) Serve as the coordinating law enforcement agency to alert

34 the public of abducted children through the Arkansas Amber Alert System; and

35  (2) Establish the criteria for activation of the Arkansas Amber

36 Alert System.

2   12-8-702. Arkansas Silver Alert System.

3   (a) There is established the Arkansas Silver Alert System to be

4 administered by the Division of Arkansas State Police.

5   (b) The division shall:

6           (1) Serve as the coordinating law enforcement agency to

7 disseminate statewide alerts for missing seniors and adults with cognitive

8 disorders through the Arkansas Silver Alert System; and

9           (2) Establish the criteria for activation of the Arkansas Silver

10 Alert System.

12  12-8-703. Missing Endangered Adult Advisory System.

13  (a) There is established a standardized system to aid in the search of

14 missing adults to be known as the Missing Endangered Adult Advisory System.

15  (b) The Division of the Arkansas State Police shall serve as the

16 coordinating law enforcement agency to disseminate appropriate advisories

17 under the Missing Endangered Adult Advisory System.

18  (c)(1) The Missing Endangered Adult Advisory System shall be used for

19 a missing adult who does not meet the criteria for activation of the Arkansas

20 Silver Alert System who has:

21                (A) A mental or cognitive disability that is not

22 Alzheimer's disease or a dementia-related disorder;

23                (B) An intellectual disability, developmental disability,

24 or brain injury; or

25                (C) Another physical, mental, or emotional disability that

26 is not related to substance abuse.

27          (2) The Missing Endangered Adult Advisory Stytem will not be

28 activated for a person who is determined to be suicidal.

29  (d) The Missing Endangered Adult Advisory System shall have safeguards

30 in place to ensure that activation of the Missing Endangered Adult Advisory

31 System:

32          (1) Is the only viable means by which the missing adult is

33 likely to be returned to safety;

34          (2) Provides for the protection of the privacy, dignity, and

35 independence of the missing adult;

36          (3) Prevents the inadvertent or unnecessary broadcasting or

1 dissemination of sensitive health information; and

2               (4) Only occurs when there is sufficient descriptive information

3 about the missing adult and the circumstances surrounding his or her

4 disappearance to indicate that activating an advisory is likely to help

5 locate the missing adult.

6   (e) The division shall:

7               (1) Establish the procedure for activation of the Missing

8 Endangered Adult Advisory System;

9               (2) Monitor the use, activation, and results of the Missing

10 Endangered Adult Advisory System; and

11              (3) Coordinate with local law enforcement to ensure the

12 appropriate use of the Missing Endangered Adult Advisory System.

14  12-8-704. Rulemaking.

15  The Department of Public Safety may promulgate rules to implement this

16 subchapter.
