12  ADMINISTRATION; TO REQUIRE THE SECRETARY OF THE

13  DEPARTMENT OF FINANCE AND ADMINISTRATION AND THE

14  DEPARTMENT OF FINANCE AND ADMINISTRATION TO RESPOND

15  TO A WRITTEN REQUEST FOR A LEGAL OPINION OR A RENEWAL

16  OF A LEGAL OPINION WITHIN A CERTAIN AMOUNT OF TIME;

17  AND FOR OTHER PURPOSES.

21                       TO REQUIRE THE SECRETARY OF THE

22                       DEPARTMENT OF FINANCE AND ADMINISTRATION

23                       AND THE DEPARTMENT OF FINANCE AND

24                       ADMINISTRATION TO RESPOND TO A WRITTEN

25                       REQUEST FOR A LEGAL OPINION WITHIN A

26                       CERTAIN AMOUNT OF TIME.

28 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

30  SECTION 1. Arkansas Code Title 26, Chapter 18, Subchapter 3, is

31 amended to add an additional section to read as follows:

32  26-18-315. Written legal opinions -- Issuance.

33  A written legal opinion issued by the Secretary of the Department of

34 Finance and Administration or the Department of Finance and Administration as

35 required by law or under the rules promulgated by the department shall be

36 issued within:

1   (1) Ninety (90) days of the secretary or the department

2 receiving a written request for the written legal opinion; or

3   (2) Forty-five (45) days of the secretary or the department

4 receiving a written request for renewal of a legal opinion previously issued

5 by the secretary or the department if there has been no change in the

6 statutory law, court interpretation, or department rules affecting the legal

7 opinion previously issued by the secretary or the department.
