13 EXPLICIT CONDUCT INVOLVING A CHILD; AND FOR OTHER

18 TO CREATE THE OFFENSE OF CREATING,
19 DISTRIBUTING, POSSESSING, OR VIEWING
20 ARTIFICIAL INTELLIGENCE-GENERATED MATTER
21 DEPICTING SEXUALLY EXPLICIT CONDUCT
22 INVOLVING A CHILD.

24 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

26 SECTION 1. Arkansas Code � 5-27-601, concerning definitions used
27 regarding computer crimes against minors, is amended to add an additional
28 subdivision to read as follows:
29 (16) "Indistinguishable" means appearing to an ordinary person to be
30 an authentic depiction.

32 SECTION 2. Arkansas Code Title 5, Chapter 6, Subchapter 6, is amended
33 to add an additional section to read as follows:
34 5-27-611. Creating, distributing, possessing, or viewing artificial
35 intelligence-generated matter depicting sexually explicit conduct involving a
36 child.

1 (a) A person commits creating, distributing, possessing, or viewing
2 artificial intelligence-generated matter depicting sexually explicit conduct
3 involving a child if the person knowingly:
4 (1) Uses artificial intelligence or other computer technology
5 capable of processing and interpreting specific data inputs to generate
6 visual depictions to create a depiction of a child engaging in sexually
7 explicit conduct that is indistinguishable from a child actually engaging in
8 sexually explicit conduct;
9 (2) Receives for the purpose of selling or knowingly sells,
10 procures, manufactures, gives, provides, lends, trades, mails, delivers,
11 transfers, publishes, distributes, circulates, disseminates, presents,
12 exhibits, advertises, offers, or agrees to offer through any means an
13 artificial intelligence-generated or computer-generated depiction that is
14 indistinguishable from a child actually engaging in sexually explicit
15 conduct; or
16 (3) Possesses or views through any means an artificial
17 intelligence-generated or computer-generated depiction that is
18 indistinguishable from a child actually engaging in sexually explicit
19 conduct.
20 (b) Creating, distributing, possessing, or viewing artificial
21 intelligence-generated matter depicting sexually explicit conduct involving a
22 child is a:
23 (1) Class C felony for the first offense; and
24 (2) Class B felony for any subsequent offense.
