10            AN ACT TO LIMIT THE NUMBER OF CREDITS A STUDENT MAY

11            OBTAIN IN A COURSE CREDIT RECOVERY PROGRAM; AND FOR

12            OTHER PURPOSES.

20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22  SECTION 1. Arkansas Code Title 6, Chapter 16, Subchapter 1, is amended

23 to add an additional section to read as follows:

24  6-16-163. Course credit recovery program -- Limitation on credits

25 obtained.

26  (a) Beginning with the entering ninth grade class of 2025-2026, a

27 student participating in a course credit recovery program in order to obtain

28 credit toward high school graduation requirements shall not obtain more than

29 ten (10) total credits in the course credit recovery program during grades

30 nine through twelve (9-12).

31  (b) However, this section shall not apply to a:

32            (1) Student with an individualized education program if the

33 student's individualized education program includes a course recovery

34 program;

35            (2) Student who is in foster care;

36            (3) Student who is in the custody of the Division of Youth

1 Services;

2               (4) Student who is considered homeless under the McKinney-Vento

3 Homeless Assistance Act, 42 U.S.C. � 11431 et seq., as it existed on January

4 1, 2025;

5               (5) Student who is in long-term placement in a mental health

6 facility;

7               (6) Student who is in long-term placement in a medical hospital

8 due to unforeseen circumstances, including without limitation a medical

9 procedure or an accident;

10              (7) Student who is pregnant;

11              (8) Student who is determined to be high-risk or in need of Tier

12 III intensive intervention services according to the Division of Elementary

13 and Secondary Education Alternative Education Process Guide;

14              (9) Student who is enrolled full-time in a statewide open-

15 enrollment virtual charter school;

16              (10) Student who is being served or has been served in an

17 English as a Second Language program in grades nine through twelve (9-12); or

18              (11) Student who is enrolled in a credit recovery open-

19 enrollment public charter school.

20  (c) As used in this section, "long-term placement" means the placement

21 of a student in a mental health facility or medical hospital for prescribed

22 care that results in the student being absent from school for a cumulative

23 total of thirty (30) or more days during a single academic semester while the

24 student is enrolled in school and attempting to earn credit towards

25 graduation.
