12  IN CERTAIN CIRCUMSTANCES; AND FOR OTHER PURPOSES.

16                       TO AMEND THE LAW CONCERNING SCRIVENER'S

17                       AFFIDAVITS; AND TO ALLOW A LICENSED

18                       ENGINEER, SURVEYOR, OR NOTARY PUBLIC TO

19                       EXECUTE AND RECORD A SCRIVENER'S

20                       AFFIDAVIT IN CERTAIN CIRCUMSTANCES.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24  SECTION 1. Arkansas Code � 18-12-108(b), concerning who may execute

25 and record a scrivener's affidavit, is amended to add additional subdivisions

26 to read as follows:

27  (5) Licensed engineer or surveyor who prepared the original

28 survey, plat, replat, lot split, boundary line adjustment, or other

29 instrument that affects or is related to the title to the real property; or

30  (6) Notary public who witnessed the execution of an original

31 instrument and executed an acknowledgement to the original instrument that

32 contains an error.
