11  SEX OFFENDER FROM ENTERING A WATER PARK, SWIMMING

12  AREA, OR CHILDREN'S PLAYGROUND OF A PUBLIC PARK; AND

13  FOR OTHER PURPOSES.

19                       A WATER PARK, SWIMMING AREA, OR

20                       CHILDREN'S PLAYGROUND OF A PUBLIC PARK.

22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24  SECTION 1. Arkansas Code � 5-14-133 is repealed.

25  5-14-133. Registered offender prohibited from entering a water park

26 owned or operated by a local government.

27  (a) As used in this section, "water park" means a recreational aquatic

28 facility that has among its features a swimming pool, wave pool, splash pad,

29 water slide, or other area dedicated to aquatic activities for children and

30 is open to the general public.

31  (b) It is unlawful for a person who is required to register under the

32 Sex Offender Registration Act of 1997, � 12-12-901 et seq., and who has been

33 assessed as a Level 3 or Level 4 offender to knowingly enter a water park

34 owned or operated by a local government.

35  (c) A violation of this section is a Class D felony.

1   SECTION 2. Arkansas Code � 5-14-134 is amended to read as follows:

2   5-14-134. Registered offender prohibited from entering a water park,

3 swimming area, or children's playground contained within an Arkansas State

4 Park a public park.

5   (a) As used in this section:

6   (1) "Arkansas State Park" means a state park classified or

7 reclassified as an official state park under � 22-4-201(1) or � 22-4-202;

8   (2) "Children's playground" means a place with a specific design

9 for children to be able to play there, whether indoor or outdoor; and

10  (2)(A) "Public park" means any property owned or maintained by

11 this state or a county, city, town, or political subdivision in this state

12 for the recreational use of the public.

13                   (B) "Public park" includes without limitation the portion

14 of any privately owned land over which an easement has been granted to the

15 state or a county, city, town, or political subdivision and that is used as

16 part of the public park system of the state or a county, city, or town;

17  (3) "Swimming area" means a place with a specific design for

18 people to swim, including without limitation a beach, a swimming pool, and a

19 water park.; and

20  (4) "Water park" means a recreational aquatic facility that has

21 among its features a swimming pool, wave pool, splash pad, water slide, or

22 other area dedicated to aquatic activities for children and is open to the

23 general public.

24  (b) It is unlawful for a person who is required to register under the

25 Sex Offender Registration Act of 1997, � 12-12-901 et seq., and who has been

26 assessed as a Level 3 or Level 4 offender to knowingly enter a within one

27 hundred feet (100') of a water park, swimming area, or children's playground

28 contained within an Arkansas State Park a public park.

29  (c) A violation of this section is a Class D felony.
