21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

23 SECTION 1. Arkansas Code Title 20, Chapter 57, Subchapter 2, is
24 amended to add an additional section to read as follows:
25 20-57-210. Location restrictions for certain food processing plants
26 operating a slaughterhouse -- Definition.
27 (a)(1) As used in this section, "food processing plant" means a
28 commercial operation that processes food for human consumption and provides
29 processed food for sale and distribution to other entities.
30 (2) "Food processing plant" does not include a retail food
31 store, convenience store, food market, delicatessen, restaurant, or
32 cafeteria.
33 (b) A food processing plant operating a slaughterhouse on the same
34 grounds as the food processing plant that is located within a city of the
35 first class shall not operate within two (2) miles of a:
36 (1) Church;

1 (2) Public school; or
2 (3) Densely populated residential area.
3 (c) This section does not prevent a city of the first class from
4 undertaking a process to approve or otherwise regulate the operations of a
5 food processing plant operating a slaughterhouse on the same grounds as the
6 food processing plant, including without limitation making a determination
7 that the food processing plant would operate in violation of subsection (b)
8 of this section.
9 (d) This section does not apply to a food processing plant that is
10 operating on the effective date of this section.
