17 TO AMEND THE DEFINITIONS UNDER THE
18 DOMESTIC ABUSE ACT OF 1991; AND TO
19 PROHIBIT THE ISSUANCE OF AN ORDER OF
20 PROTECTION ENJOINING A PARTY FROM
21 ENGAGING IN COURSE OF CONTROL OR
22 DISTURBING THE PEACE EX PARTE.

24 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

26 SECTION 1. Arkansas Code � 9-15-103(4), concerning the definition of
27 "domestic abuse" under the Domestic Abuse Act of 1991, is amended to read as
28 follows:
29 (4) "Domestic abuse" means:
30 (A) Physical harm, bodily injury, assault, or the
31 infliction of fear of imminent physical harm, bodily injury, or assault
32 between family or household members; or
33 (B) Any sexual conduct between family or household
34 members, whether minors or adults, that constitutes a crime under the laws of
35 this state; or
36 (C) A pattern of behavior as defined by "course of

1 control" or "disturbing the peace" under � 9-15-219;

3 SECTION 2. Arkansas Code � 9-15-219(a)(2), concerning the definition
4 of "disturbing the peace" under the Domestic Abuse Act of 1991, is amended to
5 read as follows:
6 (2)(A) "Disturbing the peace" means a pattern of behavior that
7 unreasonably destroys the mental or emotional calm of a family or household
8 member based on the totality of the circumstances.
9 (B) "Disturbing the peace" includes without limitation
10 course of control.

12 SECTION 3. Arkansas Code � 9-15-219(b), concerning the entry of an
13 order enjoining a party from engaging in course of control or disturbing the
14 peace under the Domestic Abuse Act of 1991, is amended to read as follows:
15 (b) A court may enter an ex parte order enjoining a party from
16 engaging in course of control or disturbing the peace, including without
17 limitation through one (1) or more of the following acts:
