9               AN ACT TO INCREASE ACCESSIBILITY WHILE ENSURING

10              QUALITY FOR CERTAIN FACILITIES PERFORMING MAMMOGRAPHY

11              SERVICES; TO AMEND THE LAW CONCERNING THE QUALITY

12              STANDARDS FOR ACCREDITATION OF FACILITIES FOR

13              MAMMOGRAPHY; AND FOR OTHER PURPOSES.

20                       AMEND THE LAW CONCERNING THE QUALITY

21                       STANDARDS FOR ACCREDITATION OF

22                       FACILITIES FOR MAMMOGRAPHY.

24 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

26  SECTION 1. Arkansas Code � 20-15-1004(a), establishing quality

27 standards for accreditation of facilities for mammography, is amended to read

28 as follows:

29  (a)(1) The Secretary of the Department of Health shall establish

30 quality standards for accreditation of facilities wherein mammography may be

31 conducted in accordance with according to the Mammography Quality Standards

32 Act of 1992, Pub. L. No. 102-539 (21 C.F.R. Part 900).

33              (2) The standards applicable to the physician who interprets

34 mammograms shall not be more stringent than those standards listed in the

35 Mammography Quality Standards Act of 1992, Pub. L. No. 102-539 (21 C.F.R.

36 Part 900).

1             (3)(A) An interpreting physician is not required to be on site

2 but shall be immediately available via telecommunication to interpret

3 diagnostic mammography to adhere to the quality standard requirements under

4 subdivision (a)(2) of this section.

5             (B) A patient shall sign a waiver acknowledging that a

6 diagnostic evaluation performed via telemedicine or remotely may have

7 limitations compared to an in-person diagnostic evaluation.

8             (C) The results of the diagnostic evaluation shall be

9 provided to the patient before the patient leaves the facility after the

10 completion of the diagnostic evaluation.

12  SECTION 2. DO NOT CODIFY. Rule modification.

13  (a) The Department of Health shall modify all rules relating to

14 performing diagnostic mammography services and the accreditation of

15 facilities in which diagnostic mammography may be conducted to allow

16 interpreting physicians to be immediately available via telecommunication.

17  (b) The department shall remove a requirement to have the interpreting

18 physician physically on site for the performance of diagnostic mammography

19 services.
