10        MODIFY THE CONTENTS OF DRIVER'S LICENSES AND

11        IDENTIFICATION CARDS; TO AMEND THE CONTENTS OF A

12        DRIVER'S LICENSE OR IDENTIFICATION CARD FOR CERTAIN

13        NONCITIZENS; TO CREATE A TRAINING REQUIREMENT FOR

14        ELECTION OFFICIALS REGARDING THE DRIVER'S LICENSES OR

15        IDENTIFICATION CARDS OF CERTAIN NONCITIZENS; TO AMEND

16        ARKANSAS CONSTITUTION, AMENDMENT 51, SECTION 13; AND

17        FOR OTHER PURPOSES.

21                       TO CREATE THE ONLY CITIZENS VOTE ACT; TO

22                       AMEND THE LAW CONCERNING THE DRIVER'S

23                       LICENSES AND IDENTIFICATION CARDS OF

24                       CERTAIN NONCITIZENS; AND TO AMEND

25                       ARKANSAS CONSTITUTION, AMENDMENT 51,

26                       SECTION 13.

28 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

29

30        SECTION 1. DO NOT CODIFY. Title.

31        This act shall be known and may be cited as the "Only Citizens Vote

32 Act".

33

34        SECTION 2. Under the authority permitted under Arkansas Constitution,

35 Amendment 51, � 19, Arkansas Constitution, Amendment 51, � 13(b)(1)(C),

36 concerning verification of voter registration, is amended to read as follows:

1                   (C) Documents and identification cards that comply with

2 the requirements of subdivision (b)(1)(A) of this section include without

3 limitation:

4                           (i) A driver's license, except as provided by

5 Arkansas Code � 27-16-801(b)(2)(C);

6                           (ii) A photo identification card, except as provided

7 by Arkansas Code � 27-16-805(e)(2);

8                           (iii) A concealed handgun carry license;

9                           (iv) A United States passport;

10                          (v) An employee badge or identification document

11 issued by an accredited postsecondary educational institution in the State of

12 Arkansas;

13                          (vi)(iv) A United States military identification

14 document; and

15                          (vii) A public assistance identification card if the

16 card shows a photograph of the person to whom the document or identification

17 card was issued; and

18                          (viii)(v) A voter verification card under Arkansas

19 Code � 7-5-324.

21  SECTION 3. Arkansas Code � 7-1-101(40)(C)(i)--(viii), concerning the

22 documents and identification cards that meet the definition of "verification

23 of voter registration" used in relation to elections, is amended to read as

24 follows:

25                          (i) A driver's license, except as provided under �

26 27-16-801(b)(2)(C);

27                          (ii) A photo identification card, except as provided

28 under � 27-16-805(e)(2);

29                          (iii) A concealed handgun carry license;

30                          (iv) A United States passport;

31                          (v) An employee badge or identification document

32 issued by an accredited postsecondary educational institution in the State of

33 Arkansas;

34                          (vi)(iv) A United States Armed Forces identification

35 document; and

36                          (vii) A public assistance identification card if the

1 card shows a photograph of the person to whom the document or identification

2 card was issued; and

3                           (viii)(v) A voter verification card under � 7-5-324;

5   SECTION 4. Arkansas Code � 7-4-109(e)(2)(D), concerning the

6 qualifications of state and county election commissioners, election

7 officials, poll workers, and certified election monitors, is amended to read

8 as follows:

9                     (D)(i) The State Board of Election Commissioners shall

10 promulgate rules under the Arkansas Administrative Procedure Act, � 25-15-201

11 et seq., concerning the training requirements, materials, and examination of

12 essential skills.

13                          (ii) The training required under subdivision

14 (e)(2)(D)(i) of this section shall include instruction on recognizing and

15 refusing a driver's license under � 27-16-801(b)(2)(C) or an identification

16 card under � 27-16-805(e)(2) that is not valid for voter identification

17 purposes.

19  SECTION 5. Arkansas Code Title 7, Chapter 5, Subchapter 1, is amended

20 to add an additional section to read as follows:

21  7-5-113. Reporting of persons holding noncitizen driver's license or

22 identification card.

23  (a) The Secretary of the Department of Finance and Administration

24 shall prepare and deliver to the Secretary of State a monthly report listing

25 the names and identifying information of each person holding a driver's

26 license issued under � 27-16-801(a)(1)(C) or an identification card under �

27 27-16-805(b)(1)(D).

28  (b)(1)(A) Upon receipt of the report prepared under subsection (a) of

29 this section, the Secretary of State shall verify if any person listed in the

30 report is listed in the voter registration record files maintained by the

31 Secretary of State.

32                    (B) The Secretary of State may use any database available

33 to the office of the Secretary of State to assist in the verification of the

34 citizenship of a person listed in the report prepared under subdivision (a)

35 of this section.

36             (2) If a person listed in the report prepared under subsection

1 (a) of this section is found to be registered as a voter in the Secretary of

2 State's voter registration record files:

3                    (A) The Secretary of State shall notify the county clerk

4 of the county in which the person is registered to vote of the identity of

5 the person;

6                    (B) A county clerk who receives notification under

7 subdivision (b)(2)(A) of this section shall cancel the registration to vote

8 of the person identified under subdivision (b)(2)(A) of this section; and

9                    (C) The Secretary of State shall refer to the Attorney

10 General for prosecution the person who was found to be registered as a voter

11 in the Secretary of State's voter registration files under subdivision (b)(2)

12 of this section.

13  (c)(1) The Secretary of State shall provide written notice to a person

14 who has had his or her registration to vote canceled under subdivision (b)(2)

15 of this section that the Secretary of State found that the person was not a

16 citizen of the United States, that the person possessed a driver's license

17 issued under � 27-16-801(a)(1)(C) or an identification card issued under �

18 27-16-805(b)(1)(D), that the person was referred to the Attorney General for

19 prosecution, and that the person's registration to vote was canceled.

20             (2) The written notice provided under subdivision (c)(1) of this

21 section shall inform the person that if he or she wishes to contest the

22 findings of the Secretary of State under subdivision (c)(1) of this section

23 he or she may provide evidence or documentary proof of United States

24 citizenship to the Secretary of State.

25  (d) The Secretary of State shall promulgate rules to implement this

26 section, including without limitation rules to contest a finding under

27 subdivision (c)(2) of this section.

29  SECTION 6. Arkansas Code � 27-16-801(a)(1), concerning the types of

30 licenses that may be issued by the Office of Driver Services, is amended to

31 add an additional subdivision to read as follows:

32                   (C) A license issued to a person who is not a citizen of

33 the United States shall expire no later than:

34                          (i) The expiration date of the documentary evidence

35 of person's lawful status in the United States provided under � 27-16-

36 1105(a)(1)(D)(ii)--(xi); or

1                           (ii) The period provided for under � 27-16-1111.

3         SECTION 7. Arkansas Code � 27-16-801(b)(1), concerning the contents

4 required to be contained on the face of a driver's license, is amended to add

5 an additional subdivision to read as follows:

6                  (C) A license issued under subdivision (a)(1)(C) of this

7 section shall clearly display on its face the phrase "Limited Term" or

8 "Limited-Term".

10        SECTION 8. Arkansas Code � 27-16-801(b)(2)(C), concerning the purposes

11 for which a driver's license is valid, is amended to read as follows:

12                 (C)(i) A license issued under subdivision (a)(1)(C) or

13 subdivision (b)(2)(B) of this section is not valid for:

14                            (a) Federal identification purposes; or

15                            (b) Voter identification purposes.

16                          (ii) The license issued under subdivision (a)(1)(C)

17 or subdivision (b)(2)(B) of this section shall clearly display on its face

18 the phrase "Not valid for federal identification purposes or voter

19 identification purposes".

21        SECTION 9. Arkansas Code � 27-16-801(e), concerning the administrative

22 requirements for the issuance of a driver's license, is amended to add an

23 additional subdivision to read as follows:

24            (6) A license issued under subdivision (a)(1)(C) of this section

25 shall be:

26                 (A) Distinctive in appearance from the regular driver's

27 license issued to a person who is twenty-one (21) years of age or older; and

28                 (B) Printed in a vertical or portrait format.

30        SECTION 10. Arkansas Code � 27-16-805(b), concerning the issuance of

31 identification cards, is amended to add an additional subdivision to read as

32 follows:

33            (3) If the applicant is not a citizen of the United States and

34 provided evidence of his or her lawful status in the United States under �

35 27-16-1105(a)(1)(D)(ii)--(xi), the identification card shall expire no later

36 than:

1   (A) The expiration date of the documentary evidence of

2 person's lawful status in the United States provided under � 27-16-

3 1105(a)(1)(D)(ii)--(xi); or

4   (B) The period provided for under � 27-16-1112.

6   SECTION 11. Arkansas Code � 27-16-805(c), concerning the issuance of

7 identification cards, is amended to read as follows:

8   (c)(1) Except as provided in subsection (e) of this section, each

9 identification card shall contain:

10  (1)(A) A color photograph of the applicant;

11  (2)(B) A physical description of the applicant;

12  (3)(C) The birthdate of the applicant;

13  (4)(D) The address of the applicant;

14  (5)(E) The date of issue; and

15  (6)(F) The expiration date.

16  (2) If the applicant is not a citizen of the United States and

17 has provided evidence of his or her lawful status in the United States under

18 � 27-16-1105(a)(1)(D)(ii)--(xi), the identification card shall:

19  (A) Be distinctive in appearance from an identification

20 card issued to a citizen of the United States;

21  (B) Clearly display on its face the phrase "Limited Term"

22 or "Limited-Term"; and

23  (C) Be printed in a vertical or portrait format.

25  SECTION 12. Arkansas Code � 27-16-805(e)(2), concerning the issuance

26 of identification cards is amended to read as follows:

27  (2)(A) An identification card issued under subdivision (b)(1)(C)

28 or subdivision (e)(1) of this section is not valid for:

29                          (i) Federal identification purposes; or

30                          (ii) Voter identification purposes.

31  (B) The identification card issued under subdivision

32 (b)(1)(C) or subdivision (e)(1) of this section shall clearly display on its

33 face the phrase "Not valid for federal identification purposes or voter

34 identification purposes".

36  SECTION 13. EFFECTIVE DATE. Sections 1-12 of this act are effective
