9             AN ACT TO REQUIRE CERTAIN REPORTING BY THE DESIGNATED

10            PROTECTION AND ADVOCACY AGENCY FOR THE STATE AND THE

11            DESIGNATED CLIENT ASSISTANCE PROGRAM FOR THE STATE TO

12            THE HOSPITAL, MEDICAID, AND DEVELOPMENTAL

13            DISABILITIES STUDY SUBCOMMITTEE OF LEGISLATIVE

14            COUNCIL; AND FOR OTHER PURPOSES.

18                       TO REQUIRE CERTAIN REPORTING BY THE

19                       DESIGNATED PROTECTION AND ADVOCACY

20                       AGENCY FOR THE STATE AND THE DESIGNATED

21                       CLIENT ASSISTANCE PROGRAM FOR THE STATE.

23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

25  SECTION 1. Arkansas Code Title 10, Chapter 3, Subchapter 3, is amended

26 to add an additional section to read as follows:

27  10-3-321. Reporting on protection and advocacy for individuals with

28 developmental disabilities.

29  (a) The designated Protection and Advocacy Agency for the state and

30 the designated Client Assistance Program for the state shall:

31            (1) Submit biannual reports to the Hospital, Medicaid, and

32 Developmental Disabilities Study Subcommittee of Legislative Council and the

33 Governor regarding efforts to advocate for all individuals with developmental

34 disabilities who live in a home- and community-based setting and not a

35 facility;

36            (2) Attend meetings of the Hospital, Medicaid, and Developmental

1 Disabilities Study Subcommittee of Legislative Council when requested; and

2   (3) Provide information requested by the Hospital, Medicaid, and

3 Developmental Disabilities Study Subcommittee of Legislative Council to the

4 Hospital, Medicaid, and Developmental Disabilities Study Subcommittee of

5 Legislative Council at the earliest opportunity but no later than the date

6 designated by the Hospital, Medicaid, and Developmental Disabilities Study

7 Subcommittee of Legislative Council.

8   (b) The Hospital, Medicaid, and Developmental Disabilities Study

9 Subcommittee of Legislative Council shall review all reports submitted by the

10 designated Protection and Advocacy Agency for the state and the designated

11 Client Assistance Program.

12  (c) The Freedom of Information Act of 1967, � 25-19-101 et seq.,

13 applies to Disability Rights of Arkansas, Inc. or its successor organization

14 that is the designated Protection and Advocacy Agency for the state and the

15 designated Client Assistance Program for the state.
