9       AN ACT TO ENCOURAGE STATE AGENCIES TO AWARD A PORTION

10      OF STATE CONTRACTS TO ARKANSAS BUSINESSES THAT HAVE

11      BEEN IN OPERATION FOR LESS THAN FIVE YEARS; AND FOR

12      OTHER PURPOSES.

16                       TO ENCOURAGE STATE AGENCIES TO AWARD A

17                       PORTION OF STATE CONTRACTS TO ARKANSAS

18                       BUSINESSES THAT HAVE BEEN IN OPERATION

19                       FOR LESS THAN FIVE YEARS.

21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

23      SECTION 1. Arkansas Code Title 19, Chapter 11, Subchapter 1, is

24 amended to add an additional section to read as follows:

25      19-11-108. Award of contracts to Arkansas businesses in operation less

26 than five years -- Definition.

27      (a) As used in this section, "state agency" means the same as defined

28 under � 19-11-203.

29      (b) The Office of State Procurement shall encourage each state agency

30 to award at least five percent (5%) of contracts entered into by the state

31 agency to businesses:

32      (1) That have been in operation for less than five (5) years;

33 and

34      (2) Whose principal place of business is in this state.
